|Think of this as part two of
Recherche du trillions perdu, my Online Journal article on Dov Zakheim,
former Bush appointee as Pentagon Comptroller from May 4, 2001 to March
10, 2004. At that time he was unable to explain the disappearance of $1
trillion dollars. Actually, nearly three years earlier, Donald Rumsfeld
announced on September 10, 2001 that an audit discovered $2.3 trillion was
also missing from the Pentagon books. That story, as I mentioned, was
buried under 9-11’s rubble. The two sums disappeared on Zakheim’s
Yet on May 6, 2004, Zakheim took a lucrative position at Booz Allen Hamilton, one of the most prestigious strategy consulting firms in the world. One of its clients then was Blessed Relief, a charity said to be a front for Osama bin Laden. Booz, Allen & Hamilton (Woolsey, VP- Booz Allen) then also worked closely with DARPA, the Defense Advanced Research Projects Agency, which is the research arm of the Department of Defense. So the dark card was shifted to another part of the deck.
Judicial Inc’s bio of Dov (linked below) tells us Zakheim was/is a dual Israeli/American citizen and an ordained rabbi and had been tracking the halls of US government for 25 years, casting defense policy and influence on Presidents Reagan, Clinton, Bush Sr. and Bush Jr. He is, as I described him earlier, the bionic Zionist. In fact, Judicial Inc points out that most of Israel’s armaments were gotten thanks to him. Squads of US F-16 and F-15 were classified military surplus and sold to Israel at a fraction of their value.
Judicial Inc also points out that Israel, a country of 4.8 million Russian and Polish Jewish émigrés, flies on one of the biggest Air Forces in the world, thanks to Dov. Conflict of interest here? Depends on what you’re interested in. That is, in 2001 Dov was CEO of SPS International, part of System Planning Corporation, a defense contractor majoring in electronic warfare technologies, including remote-controlled aircraft systems, and the notorious Flight Termination System (FTS) technology that could hijack even a hijacked plane and land or crash it wherever.
More from the resume: Wikipedia points out that Zakheim is also a member of the Council on Foreign Relations and in 2000 a co-author of the Project for the New American Century’s position paper, Rebuilding America’s Defenses, advocating the necessity for a Pearl-Harbor-like incident to mobilize the country into war with its enemies, mostly Middle Eastern Muslim nations.
As to Dov’s hell-raiser lineage, Judicial Inc points out that Grandpa Zakheim was born in 1870, Julius Zakheim (Zhabinka), in the Ukraine, a Russian rabbi who married a relative of Karl Marx. He was a Menshevik/Bolshevik and played a leading role in the 1905 turmoil that paved the way for the 1917 Bolshevik Revolution. The Bolshevik master plan called for the state of Israel, which was chosen for its proximity to the world's oil and an area of religious significance.
Dov’s Father, Rabbi Jacob I. Zakheim was born in 1910 and reared in Poland’s swarm of Zionist hard guys, read assassins and bombers. His Polish town, near Bilaystok, also brought us Yitzhak Shir, and family friends included Menachem Begin and Moshe Arens. Dov’s father was an active member of Betar, formed in 1923 in Riga, Latvia. Its goal was to control the Middle East (and its oil). It was known that the Jewish people needed their own country and they chose Palestine and claimed it a Jewish state “on both sides of the Jordan.”
Betar was in essence a terrorist organization formed because Zionists were sick of being chased from and arrested in country after country. They wanted both a place to escape and a base for their power. Betar joined forces with the Haganah, Irgun, and Stern gangs. With no prospect of a Jewish state in sight, they argued that armed struggle against the British was the only way. Since Britain occupied Palestine and was containing them they went on a blood feast of bombings that killed hundreds of British soldiers. The British pulled out, but the Zionists continue to maul the Arabs to this day.

Returning to Dov: he was born in Brooklyn in 1943 and attended exclusive Jewish schools, spent summers in Israel Zionist camps, which trained the Zionists of the future. As to Dov’s formal education, he graduated from Columbia University in 1970 and the University of Oxford in 1972. From 1973 to 75, he attended the London school of Jewish studies, described as a “Harry Potter” type cauldron; among the subjects Jewish supremacy, Advanced Bible, Talmud, Jewish Mysticism, Holocaust, Anglo-Judaica, and Zionism. After, he was ordained a Rabbi. From 1975 to 80, Zakheim was an adjunct professor at the National War College, Yeshiva University, Columbia University and Trinity College, Hartford, Connecticut.
As he stepped into the Reagan administration, he talked them into funding development of the Lavi Fighter at a cost of $3 billion. The Lavi was a total flop and Israel dropped it, though it owed $450 million in contract fees that were cancelled. Israel, according to Judicial Inc, also created a story that China was eager to buy the Lavi. Zakheim convinced Reagan that China had to be sandbagged. Reagan gave Israel $500 million for its lost contracts. Reagan then threw in a wing of F-16’s as a bonus and sign of good will. Do we see a pattern here, personal, familial, career-wise, of over-the-top Israeli advocacy?
Again, during Zakheim’s tenure as Pentagon controller from May 4, 2001, to March 10, 2004, over $3 trillion dollars were unaccounted for. Additionally, military Information was jeopardized and military contractors billed the US for Israeli items: $50 million dollar fighter jets were rated as surplus and the list rolls on. As the scandal of the missing trillion dollars surfaced and Dov resigned, Israel was handed the finest fighter jets in the US inventory while 15 percent of US jets were grounded for lack of parts. In whose best interest was this?
But Dov is not alone. He is one of an elite group of Jewish Americans/Israelis who inter-marry and enter government. They and their Christian counterparts are called neocons and their sole purpose is directing US policy. Most of them are dual citizens and few serve in the US military. Think of Paul Wolfowitz, Elliot Abrams, Richard Perle, Ben Wattenberg, to mention a few. Whether their motivation is anger at the Muslim world, seen as a religious and territorial enemy, or a deep-rooted reaction to the Holocaust, the culmination of European anti-Semitism, their reactionary militarism becomes a world-threatening force unto itself. Hence our concern.
Dov and the World Trade Center
Perhaps not coincidentally in May 2001, when Dov served at the Pentagon, it was an SPS (his firm’s) subsidiary, Tridata Corporation, that oversaw the investigation of the first “terrorist” attack on the World Trade Center in 1993. This would have given them intimate knowledge of the security systems and structural blueprints of the World Trade Center. From the '90s through 2001, WTC Security was handled by Securacom, a Kuwait-American firm, on whose board Marvin Bush, the president’s brother, sat. After 9/11, Securacom was let go, changed its name to Stratosec, and was delisted from the Stock Exchange in 2002.
According to Conspiracy News.net writers Shadow and ‘Pax’ in Dov Zakheim and the 9/11 Conspiracy, (and I suggest you look at this link) “According to the SPC website (4), a recent customer at that time was Eglin AFB, located in Florida. Eglin is very near another Air Force base in Florida-MacDill AFB, where Dov Zakheim contracted to send at least 32 Boeing 767 aircraft, as part of the Boeing /Pentagon tanker lease agreement. (5)
”As the events of September 11, 2001 occurred, little was mentioned about these strange connections, and the possible motives and proximity of Dov Zakheim and his group. Since there was little physical evidence remaining after the events, investigators were left only with photographic and anecdotal evidence.
“There is a photograph of the Flight Termination System module, from their site.(5). Note it has a cylindrical shape, and is consistent with the size and shape of the object observed under the fuselage of flight 175. “The Boeing lease deal involved the replacement of the aging KC-135 tanker fleet with these smaller, more efficient Boeing 767s that were to be leased by Dov Zakheim's group. The planes were to be refitted with refueling equipment, including lines and nozzle assemblies.” (Remember both Flight 175, that hit the South Tower, and Flight 11, that hit the North Tower, were Boeing 767s. Flights 77 and 93 were 757s.)
“In the enlargement of flight 175’s photo, we can clearly see a cylindrical object under the fuselage, and a structure that appears to be attached to the right underside of the rear fuselage section. ”When seen in comparison, it is obvious that the plane approaching the Trade Center has both of these structures-the FTS module and the midair refueling equipment, as configured on the modified Boeing 767 tankers. Of particular interest is the long tube-like anomalous structure under the rear fuselage area of flight 175-this structure runs along the right rear bottom of the plane, as it also does on the Boeing 767 refueling tanker pictured.
”After considering this information, I [the author/s] am convinced that flight 175, as pictured on the news media and official reports, was in fact a refitted Boeing 767 tanker, with a Flight Termination System attached. Use of this system would also explain the expert handling of aircraft observed in both New York and Washington investigations, which has been officially credited to inexperienced flight school students.
“Since the refitted 767s were able to carry both passengers and a fuel load, as shown in this photo, it is likely that the plane designated Flight 175 was in fact a refitted 767 tanker, disguised as a conventional commercial passenger plane.
“As shown in this photo of a 767 being serviced, the FTS unit, when in position, would be small and unobtrusive enough to be fairly innocuous (at least to casual observers, such as passengers). The smallest circle indicates the size and position of the anomaly depicted in the photos of Flight 175. The larger circle, which is the size of the engine housing, shows the size of the anomaly in relation to the engine. Note the size and position of the open hatches on the engine housing, which would tend to discredit the widely held theory that the anomaly is an open hatch or cargo door.
“As the . . . diagram shows, all flights involved in the events traveled very near many military installations, and appear to have traveled in a manner suggesting guidance and possible transfer of the control of the planes among the bases.
”Since the evidence from the World Trade Center site was quickly removed, there is little concrete evidence of the involvement of Dov Zakheim, who has since left his position at the Pentagon. However, the proximity of Eglin AFB to MacDill AFB in Florida and Dov Zakheim's work via SPC contracts and the Pentagon leasing agreement on both of these installations, combined with SPC's access to World Trade Center structural and security information from their Tridata investigation in 1993, is highly suspicious. Considering his access to Boeing 767 tankers, remote control flight systems, and his published views in the PNAC document, it seems very likely he is in fact a key figure in the alleged terrorist attacks in New York City on September 11, 2001.”
EDITORIAL RESPONSE TO READERS' COMMENTS:

However, we do stand by our assertion that the Rabbi called for it as well, insofar that he signed his name onto this document. If he signed it he agrees with it and therefore he is calling for it.
”Some of you have argued that we are singling out Rabbi Zakheim because he is Jewish, implying that we are pushing some sort of twisted anti-Semitic agenda while noting that he is not the only one who signed the PNAC document and therefore wondering why our article is about him and not the others. In light of all this information we here at Conspiracy News Net stand by our statement that Mr. Zakheim not only called for the slamming of the WTC Towers on 9-11, but he activity took part in their demolition by providing the logistics necessary for such an attack to occur.”
Coda, a Bitter Frosting on the Cake Whether or not you agree in whole or in part with these findings, here is an eye-opening article originally from the Pittsburgh Post-Gazette by Milan Simonich. It is titled Army unit piecing together accounts of Pentagon attack, and from it comes this striking information in paragraph six . . ."One Army office in the Pentagon lost 34 of its 65 employees in the attack. Most of those killed in the office, called Resource Services Washington, were civilian accountants, bookkeepers and budget analysts. They were at their desks when American Airlines Flight 77 struck.”
Apart from the question of whether it was F 77 that struck the Pentagon, it is more than ironic that accountants, bookkeepers and budgets analysts, the very people who could pick up the financial frauds were struck. Especially since the hit was directed supposedly at the Office of Naval Intelligence. Nevertheless, Dov is busy at his Booz Allen job, involved in Strategic Services and who knows what other dark plans as we speak, even as the Middle East is under heavy fire once again from Israel and its fervid ally, the US government.

The Pentagon is actually structurally weaker than the World Trade Center. Only the outer walls were made with steel columns. The inner columns are just reinforced concrete. The wings did not 'fold in' at the WTC, nor would they 'fold in' at the Pentagon.
The right engine of a 757 could not have hit the top half of the generator trailer and bent over the fence posts?. If you return the trailer to its original position, you will see that the bent over fence posts were directly under the portion of the trailer that was struck
It is very curious and significant to identifying the attack aircraft by studying which fence posts were left standing and which were bent to the ground?

'sources'. And CBS and Ari Fleischer seem to be at odds over 'facts'
of the flight.
CBS claims to have 'eyewitnesses' that saw the plane hit the ground before hitting the Pentagon. Really. Why does CBS want to push this point?

It ignores the 30 tons of aircraft engines on a Boeing 757.
|Excerpt: "American Airlines Flight 77 slammed into the western face of the Pentagon, penetrating the first and second floors, just north of the fourth corridor in Wedge 1, and traveled at a forty-five degree angle through the building’s three outer-most rings, E, D and C, before stopping just shy of the fifth corridor in Wedge 2. The nose of Flight 77 punched out into A-E Drive, a roadway between the B and C rings. |The tail structure
of a Boeing 757 is 44'6" high, or just at the bottom of the 4th floor
of the Pentagon. The area inside the yellow square is the
entry point of the attack aircraft.
And the center line of the engines is just about level with the top of the first floor. But only two adjacent windows were even broken on the second floor (ASCE report). There's no way that a Boeing 757 crashed into this building.

|IN FRONT OF GROUND
How the National ARFF crews found themselves in front of ground zero on September 11 started with a motor vehicle accident on the upper level of the airport's Terminal B.
While Captain Defina and his crews were watching the World Trade Center attacks on television at the ARFF station, they were dispatched to the motor vehicle accident. Although the airport, located in Arlington, Virginia, was not on alert, Captain Defina said he had a feeling Washington, D.C., could be another terrorist target.
"Normally, the shift commander doesn't respond to motor vehicle accidents,'' he said. "But something didn't sound right about it."
Captain Defina was the shift commander that day because the battalion chief was across the river in Washington for a security briefing on an upcoming meeting. Defina responded to the vehicle accident in the battalion chief van, along with Rescue Engine 335, under the command of Captain John Durrer, and a medic unit.
Unknown to Captain Defina and his crews, hijacked American Airlines Flight 77, outbound from Washington Dulles International Airport with 64 people on board, was only minutes away from slamming at 0938 hours into the Pentagon, about 3 miles (4.8 kilometers) from National.
At the accident scene, where a driver with a diabetic reaction had struck several vehicles, the firefighters were working with their backs to the Pentagon.
"I heard a dull roar. The noise didn't belong with the noise you were used to hearing within the airport," Captain Defina said. "I turned and saw a smoke plume arise."

Only two windows were damaged on the second floor. This is completely inconsistent with the Titan Corporation report. They describe the attack as a steep dive.

Robert Cornwall of the Arlington County Fire Department (ACFD),
diverted from a call to a fire in nearby Rosslyn, VA, and rushed to the
scene. Upon arrival, he assumed command of the Pentagon crash site. Assistant
ACFD Chief James Schwartz arrived
5 to 10 minutes after the crash. Chief Schwartz assumed Incident Command
(IC) from Chief Cornwall and assigned him to operational supervision of
rescue and evacuation. Approximately 5 minutes after Chief Schwartz

scene and reported to Chief Schwartz (in accordance with the FRP). Chief
Schwartz and Agent Combs had an established professional relationship from
prior exercises and operations and quickly established a close working
relationship. Incident Command therefore knew very rapidly (about 30
minutes into the response) about the missing jetliner, and the safety
implications for the Pentagon rescue site (the fact that two jets had hit
the WTC complex was not lost on the incident managers at the Pentagon
site). In response, all staff was
evacuated to an area under a highway bridge adjacent to the Pentagon,
including any victims that could be moved (due to problems with
radio penetration of the Pentagon structure, several fire fighters that
were located inside the building and in the courtyard were not notified of
this initial evacuation). All
staff remained under the overpass for about 20 minutes, until it was
determined that the threat had passed (FBI liaisons conveyed the
information on the plane crash in Pennsylvania very quickly). Response
personnel returned to their activities, and the ACFD remained in position
and established the Incident Command Post (ICP) for the remainder of that
day underneath the overpass. Security for the ICP was maintained using
Arlington County SWAT team members. Other officers from the Arlington
County Police Force played a supportive role, assuming charge of traffic
around the Pentagon (in conjunction with Virginia State Police), ordering
the closure of roads surrounding it, helping evacuate the Pentagon and
helping the FBI and the other law enforcement agencies collect evidence
and search for bodies. Fairfax motorcycle officers also reported,
unrequested, outside Arlington police headquarters shortly

Exchange Commission today announced the filing of a settled enforcement
action in the United States District Court for the District of Columbia
charging The Titan Corporation ("Titan"), a San Diego,
California-based military intelligence and communications company, with
violating the anti-bribery, internal controls and books and records
provisions of the Foreign Corrupt Practices Act ("FCPA").
Simultaneously with the filing of the Commission's complaint, and without
admitting or denying its allegations, Titan consented to the entry of a
final judgment permanently enjoining it from future violations of the FCPA
and requiring it (i) to pay $15.479 million in disgorgement and
prejudgment interest, (ii) to pay a $13 million penalty, which will be
deemed satisfied by Titan's payment of criminal fines of that amount in
parallel proceedings brought by the U.S. Attorney's Office for the
Southern District of California and the U.S. Department of Justice, Fraud
Section, and (iii) to retain an independent consultant to review the
company's FCPA compliance and procedures and to adopt and implement the
The Commission's complaint alleges that, from 1999 to 2001, Titan paid more than $3.5 million to its agent in Benin, Africa, who was known at the time by Titan to be the President of Benin's business advisor. Titan failed to conduct any meaningful due diligence into the background of its agent either before his retention or thereafter and also failed to ensure that the services alleged to be performed by the agent, and described in his invoices, were in fact provided to Titan. The complaint alleges, in 2001, at the direction of at least one former senior Titan officer based in the United States, Titan funneled approximately $2 million, via its agent in Benin, towards the election campaign of Benin's then-incumbent President. The complaint also alleges that some of these funds were used to reimburse Titan's agent for the purchase to T-shirts adorned with the President's picture and instructions to vote for him in the upcoming election. According to the complaint, Titan made these payments to assist the company in its development of a telecommunications project in Benin and to obtain the Benin government's consent to an increase in the percentage of Titan's project management fees for that project. The complaint alleges that a former senior Titan officer directed that these payments be falsely invoiced by the agent as consulting services and that actual payment of the money be broken into smaller increments and spread out over time. The complaint does not allege that the then-incumbent President knew of the payments.
The Commission's complaint also alleges that, from 1999 to 2003, Titan improperly recorded payments in its books and records, directed agents to falsify invoices submitted to Titan, and failed to devise or maintain an effective system of internal controls to prevent or detect other FCPA violations. Despite utilizing over 120 agents and consultants in over 60 countries, Titan never had a formal company-wide FCPA policy, failed to implement an FCPA compliance program, disregarded or circumvented the limited FCPA policies and procedures in effect, failed to maintain sufficient due diligence files on its foreign agents, and failed to have meaningful oversight over its foreign agents.
According to the complaint, Titan falsified documents that enabled its agents to under-report local commission payments in Nepal, Bangladesh, and Sri Lanka. In addition, the complaint alleges that Titan falsified documents presented to the United States government by under-reporting payments on equipment exported to Sri Lanka, France and Japan. The complaint also alleges that Titan (i) paid a World Bank Group analyst in cash to assist Titan in its project in Benin, and (ii) paid a Benin government official approximately $14,000 in travel expenses from 1999 to 2001.
|Without admitting or denying the
allegations in the complaint, Titan has consented to the entry of a final
judgment permanently enjoining it from future violations of Sections 30A,
13(b)(2)(A), 13(b)(2)(B), and 13(b)(5) of the Securities Exchange Act of
1934 ("Exchange Act") and Rule 13b2-1 thereunder. Titan also has
agreed to disgorge $12,620,000, and to pay prejudgment interest thereon in
the amount of $2,859,195.47. Under the terms of the final judgment, Titan
will also retain an independent consultant to review the company's FCPA
compliance and procedures and will adopt and implement the consultant's
Also today the U.S. Attorney's Office for the Southern District of California and the U.S. Department of Justice, Fraud Section filed criminal FCPA charges and a tax charge against Titan, who entered a guilty plea before the Honorable Roger T. Benitez, United States District Judge for the Southern District of California (United States of America v. Titan Corporation, Case No.05cr0314-BEN (S.D. Cal.)). In particular, Titan agreed to plead guilty to one felony count of violating the anti-bribery provisions of the FCPA, one felony count for falsifying the books and records of Titan, and one felony count for violating Title 26 U.S.C. Section 7206(2) and to pay a criminal fine of $13 million.
Commission's Report Pursuant to Section 21(a) of the Exchange Act The Commission also today issued a Report of Investigation pursuant to Section 21(a) of the Exchange Act to provide guidance concerning potential liability under the antifraud and proxy provisions of the federal securities laws for publication of materially false or misleading disclosures regarding provisions in merger and other contractual agreements.
In its Report, the Commission stated that, on September 15, 2003, Titan became a party to a merger agreement with Lockheed Martin Corporation ("Lockheed") in which Lockheed agreed to acquire Titan, pending certain contingencies. Titan affirmatively represented in that merger agreement that to the knowledge of Titan, neither the company "nor any of its Subsidiaries, nor any director, officer, agent or employee of the Company or any of its Subsidiaries, has … taken any action which would cause the Company or any of its Subsidiaries to be in violation of the FCPA." This representation was publicly disclosed and disseminated by Titan in two places. The proxy statement disclosed the nature of the representation. The merger agreement containing the representation was also appended to Titan's proxy statement, which was filed with the Commission and sent to Titan's shareholders.
As the Report highlights, when an issuer makes a public disclosure of information -- via filing a proxy statement or otherwise -- the issuer is required to consider whether additional disclosure is necessary in order to put the information contained in, or otherwise incorporated into that publication, into context so that such information is not misleading. The issuer cannot avoid this disclosure obligation simply because the information published was contained in an agreement or other document not prepared as a disclosure document.
The Report is not intended to change the way issuers engage in merger, or other contractual, negotiations or to alter existing diligence obligations or to suggest, absent special circumstances (such as provisions intended to create third party beneficiaries), that provisions such as representations and covenants in such agreements are binding on or intended to benefit persons other than parties thereto. Representations, covenants, or other provisions of an agreement made by an issuer that are not public or disclosed to shareholders are not covered by the scope of this Report.
The Commission will consider bringing an enforcement action under Sections 10(b) and 14(a) of the Exchange Act and Rules 10b-5 and 14a-9 thereunder in the future if it determines that the subject matter of representations or other contractual provisions is materially misleading to shareholders because material facts necessary to make that disclosure not misleading are omitted.

and the crew of ACFD Engine 101 were en route to a training session in
Crystal City, traveling north on Interstate 395. Their conversation about
the World Trade Center attack earlier that morning was interrupted by the

At 9:38 a.m., American Airlines Flight #77 crashed into the west side of the Pentagon, just beyond the heliport. It was traveling at a speed of about400 miles per hour, accelerating with close to its full complement of fuel at the time of impact.
The destruction caused by the attack was immediate and catastrophic. The 270,000 pounds of metal and jet fuel hurtling into the solid mass of the Pentagon is the equivalent in weight of a diesel train locomotive, except it is traveling at more than 400 miles per hour. More than 600,000 airframe bolts and rivets and 60 miles of wire were instantly transformed into white-hot shrapnel. The resulting impact, penetration, and burning fuel had catastrophic effects to the five floors and three rings in and around Pentagon Corridors 4 and 5. (See detailed graphics in Appendix 4.)

|The site data indicate that the aircraft fuselage impacted the build-ing at column line 14 at an angle of approximately 42 degrees to the normal to the face of the building, at or slightly below the second-story slab. Eyewitness accounts and photographs taken by a security camera suggest that the aircraft was flying on nearly a level path essentially at grade level for several hundred feet immediately prior to impact. Gashes in the facade above the second-floor slab between column lines 18 and 20 to the south of the collapse area suggest that the aircraft had rolled slightly to the left as it entered the building. The right wing was below the second-floor wingspan of the aircraft (figure 6.1). An examination of the area encompassed by extending the line of travel of the aircraft to the face of the building shows that there are no discrete marks on the building corresponding to the positions of the outer third of the right wing. Although the official 9/11 Commission Report(CR) said Vice President Richard Cheney did not arrive at the Presidential Emergency Operations Center(PEOC) under the White House until "shortly before 10 a.m." that tragic day, Transportation Secretary Norman Mineta testified when he arrived in the room at 9:20 a.m. Cheney was already there. The timeline is important because if Cheney arrived at 10 a.m. it would have been about 20 minutes after the Pentagon was allegedly struck by a hijacked airplane at 9:38 a.m., too late for him to authorize the Air Force to shoot it down. Some 125 Pentagon employees perished in the attack.
Mineta testified "during the time that the airplane was coming in to the Pentagon, there was a young man who would come in and say to the Vice President, 'the plane is 50 miles out, the plane is 30 miles out.' And when it got to 'the plane is 10 miles out," the young man also said to the Vice President, 'Do the orders still stand?' And the Vice President...said, 'Of course the orders still stand. Have you heard anything to the contrary?"
Since the airplane was not intercepted and destroyed, even though the vice
president knew of it, "the orders" may have been to allow the
plane to hit the Pentagon. All of this, and more, is contained in the
March/April issue of "Tikkun" magazine, "a bimonthly Jewish
critique of Politics, Culture & Society." The piece was authored
by Dr. David Ray Griffin, a principal debunker of the accepted 9/11 dogma,
and published by Rabbi Michael Lerner on grounds, "if his view is
true, the position he articulates would provide adequate grounds for
impeachment of the president..."

|A little-reported investigation of a small Department of Defense
agency from 2002 to 2004 appears to be linked to a major foreign
intelligence operation and security breach in the Pentagon. WMR has been
conducting an investigation of a Department of Defense Inspector General
probe of the Defense Technology Security Administration (DTSA), which
had been merged with the larger Defense Threat Reduction Agency (DTRA)
on October 1, 1998. It was DTRA that in May 2008 flunked the 91st Bomb
Wing at Minot Air Force Base in its nuclear surety inspection of the
command for the security control of nuclear weapons after a number of
incidents, including the August 2007 unauthorized movement of six
nuclear-armed cruise missiles from Minot to Barksdale Air Force Base in
Louisiana for planned use in a military strike on Iran. The movement
involved a rival chain-of-command within the Air Force that bypassed the
Secretary of Defense and Joint Chiefs of Staff and led directly into the
office of Vice President Dick Cheney.
The placement of DTSA (called "Ditsa" by Pentagon insiders) within DTRA (called "Deetra") began in 1998 when DTSA was merged into the larger component. In July 2001, DTRA decided to move the Technology Security Directorate, as DTSA became known as part of DTRA, from its Arlington, Virginia location to Alexandria, Virginia. On July 10, 2002, the Defense Hotline, a number for whistle blowers, received three allegations forwarded from the General Accounting Office (GAO) that DTSA exceeded a cap on moving expenses when it moved from Arlington to Alexandria. However, it is clear that the Pentagon Inspector General failed to prioritize the three complaints. It was not moving expenses that were key to the complaint but that DTSA, according to a February 19, 2004 Inspector General report titled Defense Threat Reduction Agency Relocation Costs, "obtained sensitive compartmented information clearances for personnel who did not need such access, resulting in excessive costs and a potential security risk."
The IG report provides some background on DTRA and DTSA: "DTRA was established October 1, 1998, as a joint service defense agency tasked with safeguarding America and its allies from weapons of mass destruction by reducing the present threat and preparing for future threats. DTRA was created by merging elements of the Office of the Secretary of Defense, DTSA, the Defense Special Weapons Agency, and the On-Site Inspection Agency. DTRA reports to the Assistant to the Secretary of Defense (Nuclear and Chemical and Biological Defense Programs). DTRA has an authorized staff of 2,141 military and civilian personnel. The FY 2003 budget for DTRA was $2.6 billion. When DTSA was merged into DTRA, the Directorate was named the Technology Security Directorate. Subsequently, on August 31, 2001, DTSA was re-established as a separate agency and reports to the Under Secretary of Defense for Policy."
Just a mere ten days prior to the 9/11 attacks, on August 31, Deputy Defense Secretary Paul Wolfowitz re-established DTSA as a separate agency from DTRA and had its head, the Deputy Under Secretary of Defense for Technology Security Policy and Counter proliferation, report directly to Undersecretary of Defense for Policy Douglas Feith.
Stephen Younger was DTRA's director from September 1, 2001 to February 27, 2004, a few days after the IG Report was issued that absolved DTRA and DTSA of any major wrongdoing in losing classified material and inflating the need for SCI clearances. DTSA's long-serving director was David Tarbell, who served as director from August 1994 to September 23, 2001. Tarbell was replaced by Lisa Bronson. Until 1997, DTSA reported to the Assistant Secretary for International Security Policy, a position replaced by the Assistant Secretary for Strategy and Threat Reduction.
Although the IG Report concentrates on moving expense issues, it was the exceedingly large number of Sensitive Compartmented Information (SCI) clearances and the loss of classified information that is at the heart of the matter. The office relocation costs serve as a diversionary tactic. The IG Report discusses the problem with the SCI clearances: "the decision by DTRA to grant SCI clearances to its DTSA staff was not supported by the position description. Only five of the position descriptions for 45 employees who were granted SCI clearances from February 10, 2001, through July 31, 2002, indicated that a security clearance beyond the secret level was required. During August through September 2001, the DTRA security manager informed DTRA division chiefs that they needed to review the position descriptions under their control to ensure that the positions reflected the proper position sensitivity. However, no procedures have been implemented to correct the deficiency."
The report continues by stating that only 5 of 56 SCI clearances were correctly designated and that 45 to 51 SCI clearances had been granted beginning on February 10, 2001, but were not justified: "Security records show that 56 of the DTSA staff were granted SCI clearances from February 10, 2001, through July 31, 2002. We examined position descriptions for 45 of the 56 staff-members; 11 of the position descriptions were unavailable because of employee departures or other reasons. Of the 45 position descriptions examined, 5 were correctly prepared (4 military personnel and 1 civilian employee). Seven of the 45 position descriptions had the correct position sensitivity designations for an SCI clearance but the position description did not indicate that an SCI clearance was required. The remaining 33 positions had erroneous position sensitivity designations.
Although the DTRA security officer and his staff requested that DTRA management determine the sensitivity for each position back in 2001, no procedures have been implemented to correct the deficiency. On August 31, 2001, the Deputy Secretary of Defense reestablished DTSA as a separate agency from DTRA. Accordingly, DTSA needs to take the appropriate corrective action rather than the DTRA. DTSA needs to review the position sensitivity level designated on Office of Personnel Management Form 8 and ensure that the position levels are appropriate and in accordance with 5 C.F.R. Section 732 (2003). Additionally, DTSA needs to ensure that position sensitivity levels support the level of security clearance provided to DTSA staff."
The IG Report addresses the loss of classified material by DTSA. However, it says no further action was necessary because the classified documents were duplicates and "no longer needed" by DTSA. Whether or not classified information is duplicated, it must be disposed of properly and recorded as such. The IG Report states: "On July 15, 2001, the Inspector General, DTRA received an allegation on improper disposal of classified information by DTRA personnel. That complaint was referred to the DoD Deputy Inspector General for Investigations for review. The evidence revealed that the disposed documents were duplicates of documents retained by DTSA and other items no longer needed in carrying out the DTSA mission. The DoD Deputy Inspector General for Investigations did not substantiate the allegation. There were no audits or evaluations relating to this subject during the last 5 years."
There were some published reports that documents on the sale by the U.S. of dual-use technology to other countries, as well as top secret intelligence reports on foreign weapons acquisition programs and foreign front companies involved in the weapons trade were among the documents unaccounted for.
The IG Report also describes "urgency" by DTSA in obtaining 56 SCI clearance for personnel when they were only justified by 5 employees: "Using an Office of Personnel Management price list for background investigations, we estimate that DTRA spent about $110,000 to obtain SCI clearances for the DTSA staff. We identified the type of investigation performed for each of the 56 personnel and multiplied the number of investigations by the current price for the specified urgency. Our estimate may be slightly higher than DTRA actually paid because some of the investigations were performed prior to January 1, 2002, the effective date of the price list we used. The estimated cost of $110,000 does not include the costs that the Defense Intelligence Agency incurred for the adjudication process; those costs are not billed to the requesting agency."
The security problems at DTSA coincide with the Mossad's involvement with two officials of the American Israel Public Affairs Committee (AIPAC) and Air Force Reserve Colonel and Defense Intelligence Agency (DIA) Soviet and Iran analyst Larry Franklin, who, while on active duty, served tours at the U.S. embassy in Tel Aviv. Between 2003 and 2004, Franklin admitted that he met with two AIPAC officials, Steven Rosen and Keith Weissman and shared classified information, including SCI intelligence with them. Franklin was discovered to have had in his possession, 83 classified U.S. government documents discovered in a search of of his Kearneysville, West Virginia home in June.
Rosen and Weissman later shared the classified intelligence with an Israeli embassy official, Naor Gilon, believed to be a Mossad agent. Another co-conspirator was identified as Uzi Arad, a former Israeli intelligence agent. Franklin was also reportedly close to arch-neocon Michael Ledeen and met with Ledeen's old friend, Iranian Jewish agent-of-influence and Iran-contra figure Manucher Ghorbanifar in Rome in December 2001. The FBI investigation of the Franklin-Israeli spy ring was leaked to the media on August 27, 2004. Franklin was charged with six criminal counts, including passing classified information to an agent of a foreign government. However, he was only convicted of three charges, not including the foreign intelligence count. Franklin was convicted on January 20, 2006 and sentenced to 12 and 1/2 years in prison and given a $10,000 fine. Franklin remains free pending the often-delayed trial of Rosen and Weissman under the Espionage Act.
In what could prove embarrassing for Israel's intelligence hierarchy in Israel and the United States, U.S. Judge T.S. Ellis has approved defense requests for subpoenas of Wolfowitz and Feith, two key players involved in the DTSA operations. But the clock is running out for federal prosecutors and the possibility of a George Bush pardon for Rosen and Weissman, which would also see Franklin absolved, is real.
Problems with Israeli spies and agents-of-influence in the Pentagon have existed as a public issue ever since the term of General George "Scratchy" Brown, the Chairman of the Joint Chiefs of Staff and Air Force Chief of Staff. In October 1974, General Brown, while serving as Joint Chiefs Chairman under President Gerald Ford, was quoted in Time as telling a seminar at Duke University Law School that he hoped the United States would not use force against oil-producing nations in the Middle East. General Brown said he could foresee a "Seven Days in May" scenario in the United States if the American people began to suffer from an oil embargo. He said, "You can conjure a situation where there is another oil embargo and people in this country are not only inconvenienced and uncomfortable, but suffer. They get tough-minded enough to set down the Jewish influence in this country and break that lobby." General Brown further described the influence of the Israel lobby: "It's so strong you wouldn't believe now. We have the Israelis coming to us for equipment. We say we can't possibly get the Congress to support that. They say, 'Don't worry about the Congress. We will take care of the Congress.' Now this is somebody from another country, but they can do it." General Brown did not stop there. He added, "They own, you know, the banks in this country, the newspapers. Just look at where the Jewish money is."
Ford called General Brown into his office for a ten-minute reprimand. Defense Secretary James Schlesinger, who recently completed a study of the Air Force's nuclear security problems for Defense Secretary Robert Gates, merely called Brown's comments "unfortunate." New York Republican Senator Jacob Javits called for a full investigation of General Brown's comments.
General Brown, in an interview with a reporter in 1976, repeated his charge about Israel and called Israel a "burden" for the Defense Department. Calls for General Brown's firing were repeated but he remained as Joint Chiefs Chairman into President Jimmy Carter's term, retiring on June 21, 1978. General Brown lived only another five months -- he died at age 61 from cancer on December 5, 1978.
On December 9, 1980, investigative journalist Jack Anderson reported that the CIA launched a probe of the Air Force for leaking high-tech secrets to Israel. The joint development of cruise missiles by Israel, South Africa, and Taiwan was thought to involve the leak of "long-range nuclear delivery knowhow" by senior U.S. Air Force officers to Israel, violating a U.S. ban on such technology transfer. Anderson wrote, "While the Air Force has a long history of close ties with the Israelis, the CIA has argued that Israeli intelligence activities in the United States should be curtailed . . .What particularly worries the CIA is the possibility that the KGB routinely includes its agents among the Soviet Jews who are permitted to emigrate to Israel. Thus, the CIA fears, any technology given to Israel may wind up in the Kremlin." Anderson later reported that the CIA's agents and NSA's signals intercepts proved that Israel had provided sensitive military technology to South Africa.
One person who publicly challenged Brown was Joseph Churba, the top Middle East intelligence official in the Air Force who told a reporter that Brown's comments were "dangerously irresponsible" and pointed to a "tilt" against Israel within the Pentagon. Churba lost his clearance for signals intelligence (SIGINT) and satellite intelligence (Talent-Keyhole) and was fired for talking to the media. Churba, who hailed from a family of Syrian Sephardic rabbis, later joined the Ronald Reagan campaign as an adviser and was eventually appointed as an adviser to the Arms Control and Disarmament Agency where he worked closely with two alumni of Senator Henry "Scoop" Jackson's staff, Assistant Secretary of Defense for International Security Policy Richard Perle and Senate Armed Services Committee staffer Frank Gaffney, both of whom would become neocon supporters of the Project for the New American Century and other neocon contrivances. Churba later became president of the International Security Council, a Washington "research group" linked to the Reverend Sun Myung Moon's global propaganda empire. Churba died in 1996 from a heart attack. He was 62.
Churba, Perle, and others with a pro-Israeli bent would set out to transform the Pentagon from a place where anti-Israelis like General Brown could gain dominance and turn it into the most pro-Israeli of federal departments. And these new Pentagon officials would have the support of some high-level CIA officials who were fervently pro-Israeli, including Reagan's CIA director William Casey and the former CIA director of counter-intelligence James Jesus Angleton, who was fired by CIA director William Colby in 1974. Angleton was the architect of close CIA ties to the Mossad and he maintained those ties even after leaving the CIA. Casey was also close to the Mossad and made a number of secret trips to Israel as CIA director. It was during Casey's watch that U.S. intelligence was damaged by the Jonathan Pollard espionage affair and Israeli intelligence involvement in the Iran-contra affair.
They would be joined by others, including Stephen Bryen, who, in the 1970s, created the Jewish Institute for National Security Affairs (JINSA), along with Michael Ledeen, as a major Israel lobbying entity targeting the Pentagon's top brass. Bryen became a top aide to Perle and lobbied hard for the creation of DTSA in 1985. Bryen became DTSA's first director. As such he was able to influence what U.S. military equipment the U.S. sold to Israel and what sensitive technology could be shared with Israel. Bryen's tenure at DTSA resulted in complaints by Customs Service Commissioner William von Raab and Deputy Defense Secretary Richard Armitage that sensitive U.S. military technology was going to Israel and that some of it was being re-exported against the law.
Bryen had reportedly been under investigation for offering Defense Department documents to Israeli government agents at a Washington restaurant in 1987. Bryen was then a staffer for the Senate Foreign Relations Committee, working for Senator Clifford Case (R-NJ). Philip Heymann, the head of the Justice Department's Criminal Division, closed the case with no action taken. Bryen later went on to work with Gaffney's Center for Security Policy.
One of Bryen's chief assistants at DTSA was Norman D. Kass, the Deputy Director of Licensing for the agency. Kass was an Army tactical intelligence officer in South Vietnam and fluent in Russian and Hebrew. Kass served in the DTSA position until 1992. He eventually became Executive Secretary of the U.S./Russia Joint Commission on POWs/MIAs, set up in 1992, in part, to investigate the fate of missing U.S. military personnel from World War II, the Korean and Vietnam Wars, and the Cold War. At one point, Kass' work on POW/MIA issues earned him the wrath of conservative Republican New Hampshire Senator Bob Smith, who charged that there was never any provision for an Executive Secretariat at the U.S./Russia Joint Commission. On January 27, 1999, Smith, who served as Chairman of the Vietnam Working Groups of the US/Russian Joint Commission, wrote: "Nowhere in this plan is there reference to the requirement for the Deputy Assistant Secretary of Defense for POW/MIA Affairs to ensure that his office provides an Executive Secretariat for the U.S. Members of the U.S./Russian Joint Commission on POWs and MIAs." Smith always believed that there was a cover-up of by the Pentagon of the POW/MIA issue, particularly those from the Vietnam conflict.
In fact, Smith asked Attorney General Janet Reno to investigate Kass and other Pentagon and Defense Intelligence Agency officers for perjury before the Senate. Smith's charges were dismissed by both Senators John Kerry (D-MA) and John McCain (R-AZ).
Kass is married to Dr. Ilana Dimant-Kass, a former major in the Israeli Air Force. From 1982 to 1985, Dr. Kass, who now is known by the name "Lani" Kass, served as the director of the Russian Research Center at Booz Allen and Hamilton. Although the term Soviet was the common term during the time period, the Russian term was used for the center to veer away from the "Sovietologists" who rarely, if ever, considered Russian history and culture in relation to the USSR. Kass worked in the Pentagon under Defense Secretary Dick Cheney, as Special Assistant to the Director, Strategic Plans and Policy Directorate (J-5) at the Joint Staff. She also worked under Defense Secretaries William Cohen and Donald Rumsfeld, as Senior Policy Adviser and Special Assistant for Strategic Initiatives to the Director, Strategic Plans and Policy Directorate and later as Special Assistant to the Chief of Staff, U.S. Air Force, and Director of the Air Force Chief of Staff's Cyberspace Task Force . From 1985 to 2005, Dr. Kass also taught at the National War College in Washington, DC.
While at the war college, Dr. Kass was involved in teaching courses that would have a dramatic impact on the news and media in wartime: Military Thought and the Essence of War and Studies of Warning, Surprise and Deception. Kass has also been involved in the Pentagon's Project Checkmate, a restoration of the old group with the same name that plotted the Desert Storm air war against Iraq and is now charged with planning a war against Iran.
Kass is a graduate of the Hebrew University of Jerusalem and in 1978 she and her husband wrote, for Hebrew University, a review for the Slavic Review of two books, The Soviet Union and Black Africa, by Christopher Stevens and Soviet and Chinese Influence in the Third World, by Alvin Z. Rubinstein.
A paper written by Kass for the Air University Review in 1985 lists the following resume items: "Senior Analyst with Systems Research and Applications Corporation, Arlington, Virginia; an Adjunct Professor of Soviet Military Studies at Georgetown University; and a frequent guest lecturer at the National War College. Dr. Kass has been a senior analyst with the Advanced International Studies Institute, Bethesda, Maryland, and senior lecturer at the Israeli Defense Forces Staff College, Jerusalem, Israel."
WMR has learned that the Russian Research Center of Booz Allen was under the Advanced International Studies Institute (AISI). Upon the collapse of the Soviet Union in 1991 and the emergence of Russia as a separate nation, there was no longer any need to continue to differentiate between Soviet and Russian, and the center was closed. However, the AISI still exists, according to phone records, but there is no discernible address. One address is given as 5480 Wisconsin Avenue in Bethesda, however, it turns out to be the address for the Highland House, an apartment building that houses a number of doctor's offices and private residences. The manager, who has been at Highland House for nine years, said he never heard of or seen mail addressed to the Advanced International Studies Institute.

Kass has written a number of articles, including a few recent pieces for the right-wing Human Events. At an Air Force conference in 2006 in Washington, DC, Kass' biography on the speakers' list stated: "Dr. Kass was a key participant in the development of the National Strategy for Combating Terrorism, as well as the National Military Strategic Plan for GWOT. She also has authored 2 books and over 20 scholarly articles. Dr. Kass is a member of the Hermes Society--the DCI's Task Force on countering hostile denial and deception--and a frequent guest lecturer at a wide variety of governmental and civic fora."
There is very little information on the Hermes Society, however, the former Director of Central Intelligence (DCI) ran a program, code named FIRSTFRUITS, that collected intelligence on journalists, including this editor. On May 10, 2005, WMR reported: "NSA maintains a database that tracks unofficial and negative articles written about the agency. Code named "FIRSTFRUITS," the database is operated by the Denial and Deception (D&D) unit within SID [Signals Intelligence Division of NSA]. High priority is given to articles written as a result of possible leaks from cleared personnel." WMR reported on January 13, 2006 that FIRSTFRUITS' code name had been changed because of our revelations about its existence. It continues to operate under a new code name.
It is clear that whatever the Hermes Society is, "denial and deception," the main mission of NSA's FIRSTFRUITS and apparently, the mysterious Hermes Society, received the blessing of CIA director Porter Goss, who also served as DCI, and the National Intelligence Council.
Since WMR's revelations about FIRSTFRUITS and particularly after our exposure of the rival nuclear chain-of-command from Cheney's office through the Air Force to Air Force field nuclear activities, we have been the subject of a major "denial and deception" campaign. [Related story today]. This has included physical tails on myself and my colleague, cell phone interference, and incessant e-mail problems.
The rival chain-of-command from Cheney's office around the Secretary of Defense and Joint Chiefs and directly to military field commanders has been confirmed in Bob Woodward's book, "The War Within." Cheney and Bush used retired Army General Jack Keane to pass information to Iraq commander General David Petraeus. Likewise, Cheney's office was using a rival chain through the Air Force Chief of Staff and Secretary to create the Air Force Cyber Command as an alternate chain, one that could have had drastic consequences had not the movement in August 2007 of nuclear cruise missiles from North Dakota and Louisiana for use in a pre-staged attack on Iran been disclosed in a leak to the media by three high-ranking Air Force officers.
The Pentagon's "denial and deception" program was always intended to be used against an enemy. The neocons have decided that it is best used against not only the press but the Secretary of Defense and the Joint Chiefs of Staff.

The airliner was banking as it flew from his sight. ... Without knowing, Officer Roberts has confirmed the fly-over hypothesis that many in the 9/11 Truth Movement see as the only answer that fits the evidence. Roberts explains away this airliner as a second commercial airliner that was flying over the Pentagon reservation. However the actual eyewitnesses who were outside and had a clear field of view all attest that there was only one commercial airliner that flew anywhere near the Pentagon.

WMR has not yet discovered what the acronym stands for, however, its is limited to only a few hundred people with Sensitive Compartmented Information (SCI) Special Access Program (SAP) need-to-know access, in addition to the President and Vice President.
On September 11, 2001, PDAS was used to convey the information from the Air Force Chief of Staff to the White House, CIA, and other select agencies that the Air Force had successfully intercepted and downed a target over Pennsylvania. It is believed that the "target" in question was United flight 93, although there is no confirmation that the aircraft was in fact the one downed by Air Force interceptors.
The Air Force Chief of Staff on 9/11 was General John Jumper, who had become the top Air Force commander on September 6, 2001, just five days before the 9/11 attacks.
There is also reason to believe that the PDAS terminal at the Presidential Emergency Operations Center (PEOC) at the White House was used to coordinate the activities related to the aerial attack on the Pentagon. Transportation Secretary Norman Mineta claimed Vice President Dick Cheney was present at the PEOC at 9:25 am on the morning of 9/11, before the alleged impact of American Airlines flight 77 on the building.
Mineta testified before the 9/11 Commission that Cheney was aware of special orders concerning a plane heading toward Washington. Mineta said: "During the time that the airplane was coming into the Pentagon, there was a young man who would come in and say to the Vice President…the plane is 50 miles out…the plane is 30 miles out….and when it got down to the plane is 10 miles out, the young man also said to the vice president 'do the orders still stand?' And the Vice President turned and whipped his neck around and said “Of course the orders still stand, have you heard anything to the contrary?"
PDAS terminals are reportedly located at the White House, on board Air Force One, the Pentagon, CIA headquarters, the National Security Agency, the Boeing E-4 Advanced Airborne Command Post that was seen flying over Washington, DC on 9/11 after the attacks, the Defense Intelligence Agency at Bolling Air Force Base in Washington, DC, and the Raven Rock Mountain Complex in Pennsylvania where Cheney hid out after the 9/11 attacks.
Mineta later followed up with reporters and stated "When I overheard something about 'the orders still stand' and so, what I thought of was that they had already made the decision to shoot something down."
It now appears that PDAS was used by Cheney to implement on the morning of 9/11 a new policy issued on June 1, 2001 that provided for a "stand down" protocol that replaced a long-standing shootdown order for hijacked and suspected hijacked planes. The new order transferred the authority to shoot down aircraft from Pentagon and NORAD military commanders to the President, Vice President, or Secretary of Defense. |Able Danger was a classified military planning effort led by the
U.S. Special Operations Command (SOCOM). It was created as a result of a
directive from the Joint Chiefs of Staff in early October 1999 by
Chairman of the Joint Chiefs of Staff Hugh Shelton, to develop an
information operations campaign plan against transnational terrorism. In
December 2006, a sixteen-month investigation by the US Senate
Intelligence Committee concluded "Able Danger did not identify Mohamed
Atta or any other 9/11 hijacker at any time prior to September 11,
2001," and dismissed other assertions that have fueled 9/11 conspiracy
theories. The Senate Judiciary Committee first attempted to investigate
the matter for the Senate in September, 2005. The Pentagon "ordered five
key witnesses not to testify", according to Senate Judiciary Committee
Chairman Arlen Specter. "That looks to me as if it may be obstruction of
the committee's activities," Specter, R-Pennsylvania, said at the start
of his committee's hearing into the unit. Attorney Mark Zaid,
representing Lt. Colonel Anthony Shaffer and the other four Able Danger
employees at the Senate Judiciary Committee hearing in September, 2005,
pointed out to the Committee that his clients had been forbidden by the
Pentagon to testify to the Committee. He also discussed the Defense
Intelligence Agency's decision to suspend Lt. Colonel Shaffer's security
clearance shortly after it became known that he had provided information
to the 9/11 Commission on Able Danger. "Based on years of experience I
can say categorically that the basis for the revocation was questionable
at best."  An investigation by the Defense Department Inspector
General's office in September 2006 concluded that "the evidence did not
support assertions that Able Danger identified the September 11, 2001,
terrorists nearly a year before the attack, that Able Danger team
members were prohibited from sharing information with law enforcement
authorities, or that DoD officials reprised against LTC Shaffer for his
disclosures regarding Able Danger." The Senate panel of investigators
said there was no evidence DoD lawyers stopped analysts from sharing
findings with the FBI before the attacks. Analysts had created charts
that included pictures of then-known Al Qaeda operatives, but none
including Atta. A follow-up chart made after the attacks did show Atta.
The Senate Committee said its findings were consistent with those of the
DoD inspector general, released in September 2006.   Some people
have alleged regarding the events of 9/11 that Pentagon obstructed the

The program used data mining techniques to associate open source information with classified information in an attempt to make associations between individual members of terrorist groups as part of its original "intelligence preparation of the battlespace". The objective of this particular project was to ascertain whether the data mining techniques and open source material were effective tools in determining terrorist activities, and if the resultant data could be used to create operational plans that could be executed in a timely fashion to interrupt, capture and/or destroy terrorists or their cells. According to statements by Lt. Col. Anthony Shaffer and those of four others, Able Danger had identified the September 11, 2001, attacks leader Mohamed Atta, and three of the 9/11 plot's other 19 hijackers, as possible members of an al Qaeda cell linked to the 1993 World Trade Center bombing. This theory was heavily investigated and researched by Republican Representative Curt Weldon, vice chairman of the House Armed Services and House Homeland Security committees. In December 2006, an investigation by the US Senate Intelligence Committee concluded that those assertions could not be confirmed. It stated that they were unable to find supporting evidence regarding "one of the most disturbing claims about the Sept. 11 terrorist strikes." The existence of Able Danger, and its purported early identification of the 9/11 terrorists, was first disclosed publicly on June 19, 2005, in an article by Keith Phucas, a reporter for The Times Herald, a Norristown, Pennsylvania, daily newspaper. Eight days later, on June 27, 2005, Representative Curt Weldon, vice chairman of the House Armed Services and House Homeland Security committees, and the principal source for the Phucas article gave a special orders speech on the House floor detailing Able Danger: Mr. Speaker, I rise because information has come to my attention over the past several months that is very disturbing. I have learned that, in fact, one of our Federal agencies had, in fact, identified the major New York cell of Mohamed Atta prior to 9/11; and I have learned, Mr. Speaker, that in September 2000, that Federal agency actually was prepared to bring the FBI in and prepared to work with the FBI to take down the cell that Mohamed Atta was involved in in New York City, along with two of the other terrorists. I have also learned, Mr. Speaker, that when that recommendation was discussed within that Federal agency, the lawyers in the administration at that time said, you cannot pursue contact with the FBI against that cell. Mohamed Atta is in the U.S. on a green card, and we are fearful of the fallout from the Waco incident. So we did not allow that Federal agency to proceed. Rep. Weldon later reiterated these concerns during news conferences on February 14, 2006. He believed that Able Danger identified Mohamed Atta 13 separate times prior to 9/11 and that the unit also identified a potential situation in Yemen two weeks prior to the October 12, 2000 attack on the USS Cole. The Pentagon released a statement in response, stating that they wished to address these issues during a congressional hearing before a House Armed Services subcommittee scheduled for Wednesday, February 15, 2006. Able Danger and the 9/11 Commission Curt Weldon's assertion that Able Danger identified the 9/11 hijackers was picked up by the national media in August 2005, after it was reported in the bimonthly Government Security News. In addition to asserting that Able Danger identified the 9/11 hijackers and was prevented from passing that information onto the FBI, Weldon also alleged the intelligence concerning Able Danger was provided to the 9/11 Commission and ignored. Two 9/11 Commission members, Timothy J. Roemer and John F. Lehman, both claimed not to have received any information on Able Danger. Following the GSN report, members of the 9/11 Commission began commenting on the information they had on Able Danger and Atta. Lee H. Hamilton, former Vice Chair of the 9/11 Commission, and Al Felzenberg, a former spokesman for the 9/11 Commission, both denied that the 9/11 Commission had any information on the identification of Mohamed Atta prior to the attacks. Hamilton told the media, "The Sept. 11 commission did not learn of any U.S. government knowledge prior to 9/11 of surveillance of Mohamed Atta or of his cell.... Had we learned of it obviously it would've been a major focus of our investigation." On August 12, 2005, Hamilton and former 9/11 Commission chairman Thomas Kean issued a statement in response to media inquiries about the Commission's investigation of the Able Danger program. It stated the Commission had been aware of the Able Danger program, and requested and obtained information about it from the Department of Defense, but none of the information provided had indicated the program had identified Atta or other 9/11 hijackers. They further stated that a claim about Atta having been identified prior to the attacks had been made to the 9/11 Commission on July 12, 2004 (just days before the Commission's report was released), by a United States Navy officer employed at DOD, but that The interviewee had no documentary evidence and said he had only seen the document briefly some years earlier. He could not describe what information had led to this supposed Atta identification. Nor could the interviewee recall, when questioned, any details about how he thought a link to Atta could have been made by this DOD program in 2000 or any time before 9/11. The Department of Defense documents had mentioned nothing about Atta, nor had anyone come forward between September 2001 and July 2004 with any similar information. Weighing this with the information about Atta's actual activities, the negligible information available about Atta to other U.S. government agencies and the German government before 9/11, and the interviewer's assessment of the interviewee's knowledge and credibility, the Commission staff concluded that the officer's account was not sufficiently reliable to warrant revision of the report or further investigation. Congressman Curt Weldon issued a response to the 9/11 Commission clarifying the mission of Able Danger, expressing concern over the statements made by various members of the 9/11 Commission, and promising to push forward until it is understood why the DoD was unable to pass the information uncovered by Able Danger to the FBI, and why the 9/11 Commission failed to follow up on the information they were given on Able Danger. The 9/11 Commission has released multiple statements over the past week, each of which has significantly changed – from initially denying ever being briefed to acknowledging being briefed on both operation ABLE DANGER and Mohamed Atta. The information was omitted primarily because they found it to be suspect despite having been briefed on it two times by two different military officers on active duty. Additionally, the 9/11 Commission also received documents from the Department of Defense on ABLE DANGER. Congressman Weldon reiterated these statements in testimony before the Senate Judiciary Committee on September 21, 2005. Able Danger data destroyed In his book Countdown to Terror Weldon asserted that an Able Danger chart produced in 1999 identifying 9/11 hijackers Mohamed Atta, Marwan al-Shehhi, Khalid al-Mihdhar and Nawaf al-Hazmi had been presented to then-Deputy National Security Advisor Jim Steinberg. Weldon went on to claim that he had personally presented the chart to then-Deputy National Security Advisor Stephen Hadley in 2001, days after the 9/11 attacks. He later stated that he was no longer sure that Atta's name appeared on that document. Congressman Peter Hoekstra, who was then chairman of the House Intelligence Committee, investigated the matter at Weldon's request, was reported to have cautioned against "hyperventilating" before the completion of a "thorough" probe. Pentagon officials said they were unaware that any Able Danger material named Atta. They declined to comment on the reports as they worked to clarify the matter. On August 14, 2005, Mike Kelly, a columnist for The (Bergen) Record (New Jersey), described a telephone interview, arranged by the staff of Rep. Curt Weldon, with a man who identified himself as a member of the Able Danger team, but asked that his name not be revealed. In the interview, the man claimed his team had identified Mohamed Atta and three other 9/11 hijackers as likely Al-Qaeda terrorists operating in the United States, but were prevented from passing this information on to the FBI by government lawyers. He also claimed he was ignored by the 9/11 Commission's staff when he approached them on two occasions to explain Able Danger's work. On September 15, 2005, Weldon asserted that he had identified an employee who had been ordered to destroy the 2.5 terabytes (TB) of data collected by Able Danger two years before the 9/11 attack. A Time magazine article dated August 14, 2005, reports that Weldon admitted he is no longer sure that Atta's name was on the chart he presented to Hadley and that he was unable to verify whether this was the case, having handed over his only copy, and that a reconstruction was used for post-9/11 presentations. Weldon gave a talk at the Heritage Foundation with a chart he described as the one handed over on May 23, 2002. However, a week later he referred reporters to a recently reconstructed version of the chart in his office where, among dozens of names and photos of terrorists from around the world, there was a color mug shot of Mohammad Atta, circled in black marker. Lt. Col. Anthony Shaffer After Weldon's assertions were disputed, Lt. Col. Anthony Shaffer, a member of the Able Danger team, identified himself as Weldon's source. Shaffer claimed that he alerted the FBI in September 2000 about the information uncovered by the secret military unit "Able Danger," but he alleges three meetings he set up with bureau officials were blocked by military lawyers. Shaffer, who at the time worked for the Defense Intelligence Agency, claims he communicated to members of the 9/11 Commission that Able Danger had identified two of the three cells responsible for 9/11 prior to the attacks, but the Commission did not include this information in their final report. Shaffer's lawyer, Mark Zaid, has revealed that Shaffer had been placed on paid administrative leave for what he called "petty and frivolous" reasons and had his security clearance suspended in March 2004, following a dispute over travel mileage expenses and personal use of a work cell phone. As Lt. Col. Shaffer received a memorandum of OPCON status from Joint Task Force (JTF) 121, confirming his attachment to this element 1 November through 1 December 2004, and participating in the 75th Ranger Regiment's nighttime air assault of 11 November 2003, the controversy of his wearing the 75th Ranger Regiment patch as his "combat patch" is closed in his favor. In the Army Reserve, LtCol Shaffer is now assigned as the G6 of the 94th Division (Prov), Ft. Lee, VA. Congressman Weldon asked for a new probe into the activities undertaken to silence Lt. Col Shaffer from publicly commenting on Able Danger and Able Danger's identification of the 9/11 hijackers. Weldon called the activities "a deliberate campaign of character assassination." Shaffer has also told the story of Central Intelligence Agency (CIA) opposition to Able Danger, prior to 9/11, based on the view Able Danger was encroaching on CIA turf. According to Shaffer, the CIA representative said, "I clearly understand. We're going after the leadership. You guys are going after the body. But, it doesn't matter. The bottom line is, CIA will never give you the best information from "Alex Base" or anywhere else. CIA will never provide that to you because if you were successful in your effort to target Al Qaeda, you will steal our thunder. Therefore, we will not support this." Navy Captain Scott Phillpott Capt. Scott Phillpott confirmed Shaffer's claims. "I will not discuss this outside of my chain of command," Phillpott said in a statement to Fox News. "I have briefed the Department of the Army, the Special Operations Command and the office of (Undersecretary of Defense for Intelligence) Dr. Cambone as well as the 9/11 Commission. My story has remained consistent. Atta was identified by Able Danger in January/February 2000," he was quoted as saying. James D. Smith Shaffer's claims were also confirmed by James D. Smith, a civilian contractor who worked on Able Danger. In an interview with Fox News, Smith reported that the project had involved analysis of data from a large number of public sources and 20 to 30 individuals. Smith stated that Atta's name had emerged during an examination of individuals known to have ties to Omar Abdel Rahman, a leading figure in the first World Trade Center bombing. Major Eric Kleinsmith Major Eric Kleinsmith, who was with the Army and chief of intelligence for LIWA until February 2001, testified that he was ordered to destroy Able Danger's information. "I deleted the data," he said. "There were two sets, classified and unclassified, and also an 'all sorts,'" which contained a blend of the two, "plus charts we'd produced." Kleinsmith deleted the 2.5 terabytes of data in May and June, 2000, on orders of Tony Gentry, general counsel of the Army Intelligence and Security Command. Other witnesses The Defense Department announced its findings on September 1, 2005, after a three-week investigation into Able Danger. The statement announced the discovery of three other witnesses in addition to Shaffer and Phillpott who confirm Able Danger had produced a chart that "either mentioned Atta by name as an al-Qaeda operative [and/or] showed his photograph." Four of the five witnesses remember the photo on the chart. The fifth remembers only Atta being cited by name. The Pentagon describes the witnesses as "credible" but stated that the document which allegedly mentioned Atta could not be found. The wall
Former chief assistant U.S. attorney Andrew McCarthy and others have asserted that the Able Danger intelligence was suppressed as a result of a policy of forbidding the CIA and FBI to share intelligence known as "the wall." During the 9/11 Commission hearings, then-Attorney General John Ashcroft testified the wall was strengthened under the Clinton administration by Jamie Gorelick to prohibit sharing of terrorist intelligence within the federal government. This assertion was disputed by former senator Slade Gorton (R-WA), a member of the 9-11 Commission, who said, "nothing Jamie Gorelick wrote had the slightest impact on the Department of Defense or its willingness or ability to share intelligence information with other intelligence agencies." Gorton also asserted that "the wall" was a long-standing policy that had resulted from the Church committee in the 1970s, and that the policy only prohibits transfer of certain information from prosecutors to the intelligence services and never prohibited information flowing in the opposite direction. Skepticism
Two Attas theory Mickey Kaus of Slate.com, referring to Tom Maguire's "Two Attas" theory, speculates that "the 'Atta' fingered by Able Danger was really the first, 'Abu Nidal' Atta, and not the second, 9/11 'Al Qaeda' Atta," and that this may help explain this Able Danger issue. Snopes.com clarified a widely circulated email that claimed the two Atta's were one and the same. Another variation of the Two Attas theory reported by Kaus notes that Omar Abdel Rahman also had an associate with the name Mohamed El-Amir (a name sometimes used by Atta) who was not the Mohamed Atta involved in the 9/11 hijacking. However, Shaffer clarified that. He told 9/11 Commission staffers Able Danger identified three of the individuals in the terrorist cells that conducted the 9/11 attacks, to include Atta - Shaffer did not mention the names of any other of the 9/11 hijackers in his disclosure to the 9/11 staff. A fourth 9/11 terrorist came from the second cell. Eric Umansky states the problem this way: "In fact, the two-Atta theory only leaves one major issue unexplained: What about the three other 9/11 hijackers that Able Danger purportedly fingered? Broeckers/Hauss described in their last German book the existence of two Attas, two Jarrahs, two Hanjours and al-Shehhis. The Department of Defense released a report addressing the issue of two possible individuals with the last name of Atta and explaining that it was basically a clerical error. When we reviewed INS records, they appeared to reflect two entries by Atta into the United States on January 10, 2001, which initially raised a question as to whether Atta had entered twice on the same day or whether a second person posing as Atta also entered on January 10, 2001. The NIIS printout for the first entry reflects that Atta entered with an admission period of January 10, 2001, to September 8, 2001 (admission number 68653985708). The second record reflects a second entry on January 10, 2001, with an admission period from January 10, 2001, to July 9, 2001 (admission number 10847166009). However, this occurred because the inspector at the Miami District Office who changed Atta's admission date failed to follow the proper procedure to ensure that the previous entry would be corrected, and a new entry was created in NIIS. The inspector sent the old I-94 and the corrected I-94 to the contractor which data enters I-94s for the INS. The May 2, 2001, transaction with Atta was data entered and then uploaded to NIIS as if it were a new entry by Atta. This happened because the inspector issued a new I-94 with a new admission number on it. To prevent two entries from occurring in NIIS, the inspector should have crossed out the admission number on the new I-94, made a reference to the previous admission number and noted that it was not a new entry. It should be noted that IG report is disputed by Lt. Col. Shaffer and other Able Danger team members, some of whom were never interviewed by the IG's office nor the 9/11 commission. Congressman Weldon also claims the report was a hurried, botched up investigation that was intended to close the books on the subject rather than report on the actual facts. For example this lead was never followed: "Normen Pentolino, operations manager at the Hollywood store, said two cashiers told FBI agents they might have recognized Atta, but weren't certain. Sources inside the store said Atta may have held a BJ's membership card for more than two years." Timing Kevin Drum, writing for The Washington Monthly notes that reports of the precise date at which the information was allegedly passed to the FBI vary considerably. It is most unlikely that Able Danger would have identified a terrorist called "Mohamed Atta" before May 2000. Since 9/11, of course, we have retrieved every scrap of information ever known about Mohamed Atta, so we know what information would have been available to the Able Danger data mining operation. And what we know is that Mohamed Atta sent his first email to friends in the U.S. in March 2000 and received his first U.S. visa on May 18, 2000. Moreover, that was the first time he had ever gone by the name "Mohamed Atta." His full name is "Mohamed Mohamed el-Amir Awad el-Sayed Atta," and prior to 2000 he went by "Mohamed el-Amir." Documentation Although the Able Danger computer records were erased, to date, no electronic or paper document has showed that any connection was made to Atta before 9/11. No emails to or from the Able Danger team make any references to Atta, nor do any paper documents between the team and any other DoD teams or offices. No notes taken at any pre 9/11 meetings between the DoD and FBI, or interoffice DoD meetings, show any mention of Atta or a terrorist cell in New York. Congressional hearings
Senate Judiciary Committee Chairman Arlen Specter held a hearing on September 21, 2005, looking into the facts about Able Danger. However, Lt. Col Shaffer and the other four members of Able Danger were ordered not to testify by the Department of Defense. Senator Specter decided to go forward with the hearings anyway. Senator Specter wondered if the Posse Comitatus Act may have been the reason Defense Department attorneys would not allow Able Danger to turn over information to the FBI. The Posse Comitatus Act prevents the military from being engaged in law enforcement activities, including gathering information on U.S. persons, despite the aliens were not specifically United States citizens. Speaking on behalf of Lt. Col Shaffer, attorney Mark Zaid testified "Those within Able Danger were confident they weren't compiling information on US persons. They were potentially people connected to US persons." Zaid also strongly asserted on behalf of his clients, "Let me emphasize two specific items for clarification purposes because they have been distorted and invited undue criticism from some. At no time did Able Danger identify Mohamed Atta as being physically present in the United States. No information obtained at the time would have led anyone to believe criminal activity had taken place or that any specific terrorist activities were being planned. Again, the identification of the four 9/11 hijackers was simply through associational activities. Those associations could have been completely innocuous or nefarious. It was impossible to tell which, and the unclassified work of Able Danger was not designed to address that question." He further added that "unfortunately we are not aware of the continuing existence of any chart containing Mohamed Atta's name or photograph. The copies that would have been in the possession of the U.S. Army were apparently destroyed by March 2001. The copies within Lt Col Shaffer's files were destroyed by the DIA in approximately Spring 2004. The destruction of these files is an important element to this story and I encourage the Committee to investigate it further. It would appear, particularly given the Defense Department's outright refusal to allow those involved with Able Danger to testify today, that an obstructionist attitude exists. The question for this Committee is to investigate how far that position extends and why." Former Army Major Erik Kleinsmith, former head of the Pentagon's Land Warfare Analysis Department, testified at the hearing that he had been instructed to destroy data and documents related to Able Danger in May and June 2000. When asked whether the information could have prevented the attack on September 11 of 2001, he answered that he would not speculate to that, but that the information might have been useful. On February 14, 2006, Congressmen Curt Weldon charged that contrary to testimony, not all the data on Able Danger had been destroyed. Weldon claimed to be in contact with people in the government still able to do data-mining who got 13 hits on Mohamed Atta. Weldon also claimed that Able Danger information was found in Pentagon files as recently as two weeks prior to his statement and that a general was present when the files were taken from the cabinet. The next day, there was a joint committee meeting with the Subcommittee on Terrorism, Unconventional Threats and Capabilities and the Subcommittee on Strategic Forces, to discuss the Able Danger program. On September 21, 2006, The Washington Post reported that a Defense Department investigation into Able Danger found that Able Danger did not identify Mohamed Atta or any other hijacker before the September 11 attacks, and that a widely discussed chart was "a sample document passed to the military as an example of how to organize large amounts of data," and was created after 9/11. Inspector General's report On September 18, 2006, the Office of the Deputy Inspector General for Investigations released a report stating that Shaffer was put on leave, that the crew responsible for removing any classified documents from his office to prevent his taking them home with him found that he did not have any of the Able Danger-related documents trusted to him he claimed he had, and that despite the fact that the Army cleared him of any wrongdoing in the allegations "DIA officials would have taken action to revoke LTC Shaffer's access and clearance regardless of his disclosures to the DIA IG, the 9/11 Commission staff members, Members of Congress, or the media. The Department of Defense investigation concluded: The anti-terrorist program, Able Danger, did not identify Mohamed Atta or any other 9/11 terrorists before the 9/11 attack. Able Danger members were not prohibited from sharing intelligence information with law enforcement authorities or other agencies that could have acted on that information. In fact, Able Danger produced no actionable intelligence information. The destruction of Able Danger documentation at LIWA and Garland was appropriate and complied with applicable DoD regulations. The Able Danger program was not terminated prematurely. It concluded after it had achieved its objective and its work products were used in follow-on intelligence gathering efforts at USSOCOM." Evidence of IG cover-up Five witnesses who had worked on Able Danger and had been questioned by the Defense Department's Inspector General later told investigative journalists that their statements to the IG were distorted by investigators in the final IG's report, or the report omitted essential information that they had provided. The alleged distortions of the IG report centered around excluding any evidence that Able Danger had identified and tracked Atta years before 9/11. The witnesses reported to the journalists that the IG investigators got increasingly hostile in an effort to intimidate the witnesses into changing their testimony to drop any assertion that they had identified and tracked Atta, and this suggests a cover-up by the IG of Able Danger's findings. Witnesses reported telling Philip Zelikow, executive director of the 9/11 Commission, that Able Danger had identified Atta well before the 9/11 attacks, but Zelikow showed no interest in their testimony. With a scheduled release of August 31, 2010, Operation Dark Heart, by Anthony A. Shaffer, was released. It includes memories of his time reporting to the 9/11 commission about Able Danger's findings. The 10,000 copies of the books have not being released yet. The DOD's Defense Intelligence Agency reviewers identified more than 200 passages suspected of containing classified information. "Specifically, the DIA wanted references to a meeting between Lt. Col. Tony Shaffer, the book's author, and the executive director of the 9/11 Commission, Philip Zelikow, removed". WASHINGTON — The federal commission that probed the Sept. 11, 2001, terror attacks was told twice about "Able Danger," a military intelligence unit that had identified Mohamed Atta and other hijackers a year before the attacks, a congressman close to the investigation said Wednesday.
Rep. Curt Weldon (search), R-Pa., a champion of integrated intelligence-sharing among U.S. agencies, wrote to the former chairman and vice-chairman of the Sept. 11 commission late Wednesday, telling them that their staff had received two briefings on the military intelligence unit — once in October 2003 and again in July 2004.
Weldon said he was upset by suggestions earlier Wednesday by 9/11 panel members that it had been not been given critical information on Able Danger's capabilities and findings.
"The impetus for this letter is my extreme disappointment in the recent, and false, claim of the 9/11 commission staff that the commission was never given access to any information on Able Danger," Weldon wrote to former Chairman Gov. Thomas Kean (search) and Vice-Chairman Rep. Lee Hamilton (search). "The 9/11 commission staff received not one but two briefings on Able Danger from former team members, yet did not pursue the matter.
"The commission's refusal to investigate Able Danger after being notified of its existence, and its recent efforts to feign ignorance of the project while blaming others for supposedly withholding information on it, brings shame on the commissioners, and is evocative of the worst tendencies in the federal government that the commission worked to expose," Weldon added.
On Wednesday, a source familiar with the Sept. 11 commission — formally known as the National Commission on Terrorist Attacks Upon the United States (search) — told FOX News that aides who still had security clearances had gone back to the National Archives outside Washington, D.C., to review notes on Atta and any information the U.S. government had on him and his terror cell before the Sept. 11 attacks.

The source acknowledged that the aides were looking for a memo about a briefing given to four staff members by defense intelligence officials during an overseas trip to Afghanistan, Pakistan and Saudi Arabia in the fall of 2003.
Staffers apparently did not recall being told of the Able Danger information at that meeting and wanted to double-check their records.
Former commission spokesman Al Felzenberg told The New York Times in Thursday editions that Atta was mentioned to panel investigators during at least one meeting with a military officer. That briefing came in July 2004, less than two weeks before the commission's final report was issued to the public.
Felzenberg said the information about Atta was considered suspect because it didn't jibe with many other findings. For example, the intelligence officer said Atta was in the United States in late 1999, but travel records confirmed that he did not enter the country until late 2000.
"He wasn't brushed off," Felzenberg told The Times about the military officer's briefing. "I'm not aware of anybody being brushed off. The information that he provided us did not mesh with other conclusions that we were drawing."
But Weldon said that argument was not good enough.
"The 9/11 commission took a very high-profile role in critiquing intelligence agencies that refused to listen to outside information. The commissioners very publicly expressed their disapproval of agencies and departments that would not entertain ideas that did not originate in-house," Weldon wrote in his letter Wednesday night.
"Therefore it is no small irony," Weldon pointed out, "that the commission would in the end prove to be guilty of the very same offense when information of potentially critical importance was brought to its attention."
On Thursday, Weldon told FOX News that the military official, who was under cover when he was in Afghanistan for the October 2003 briefing, is certain he told the staffers about Atta at that time.
The military intelligence officer who attended that meeting with staffers "kept notes of that meeting and will testify under oath that he not only told" the staffers about Able Danger's mission, but about Atta.
Hamilton, a former Democratic congressman from Indiana, told FOX News on Wednesday that if Atta's name had been mentioned in the October 2003 briefing, it would have jumped out at staffers.
He said that the commission did not include the claims by Able Danger in the definitive report of the events leading up to Sept. 11 because it had no "information that the United States government had under surveillance or had any knowledge of Mohamed Atta prior to the attacks.
"It could be a very crucial incident in terms of the lead-up to 9/11. It could reveal flaws in the intelligence sharing or the lack of intelligence that we have not yet focused on," Hamilton said of the military's tracking of Atta and its inability to get domestic intelligence agencies to follow up.
Hamilton told FOX News that the commission team would get to the bottom of the confusion over what the United States knew about Atta and whether it played into the commission's investigation.
"I think the 9/11 commission's obligation at this point is to review our records very, very carefully and make very soon — we hope within the next few days — a complete statement about what happened during our investigation," Hamilton said.
Weldon said that he personally knows five members of the commission and is not attacking the integrity of any of them. He said he discussed the matter with two commissioners who told him they were never briefed about Able Danger.
"I have to ask why. I would hope there was not a deliberate attempt by someone on the 9/11 commission staff to keep this information" from the commissioners, Weldon said, adding "I find no fault right now with the commissioners."
A commission spokesman told FOX News that the panel expected to issue a statement before the end of the week.
Among the most critical facts to be determined, if the information about Atta did exist in 2000, would be who then blocked the intelligence from going to the FBI, which could have tracked down the terror cell.
"Team members believed that the Atta cell in Brooklyn should be subject to closer scrutiny, but somewhere along the food chain of administration bureaucrats and lawyers, a decision was made in late 2000 against passing the information to the FBI," Weldon wrote.

Dear Chairman Kean and Vice Chairman Hamilton:
I am contacting you to discuss an important issue that concerns the terrible events of September 11, 2001, and our country's efforts to ensure that such a calamity is never again allowed to occur. Your bipartisan work on The National Commission on Terrorist Attacks Upon the United States shed light on much that was unclear in the minds of the American people regarding what happened that fateful day, however there appears to be more to the story than the public has been told. I bring this before you because of my respect for you both, and for the 9-11 Commission's service to America.
Almost seven years ago, the National Defense Authorization Act for Fiscal Year 1999 established the Advisory Panel to Assess Domestic Response Capabilities for Terrorism Involving Weapons of Mass Destruction, otherwise known as the Gilmore Commission. The Gilmore Commission reached many of the same conclusions as your panel, and in December of 2000 called for the creation of a "National Office for Combating Terrorism." I mention this because prior to 9/11, Congress was aware of many of the institutional obstacles to preventing a terrorist attack, and was actively attempting to address them. I know this because I authored the language establishing the Gilmore Commission.
In the 1990's, as chairman of the congressional subcommittee that oversaw research & development for the Department of Defense, I paid special attention to the activities of the Army's Land Information Warfare Activity (LIWA) at Ft. Belvoir. During that time, I led a bipartisan delegation of Members of Congress to Vienna, Austria to meet with members of the Russian parliament, or Duma. Before leaving, I received a brief from the CIA on a Serbian individual that would be attending the meeting. The CIA provided me with a single paragraph of information. On the other hand, representatives of LIWA gave me five pages of far more in-depth analysis. This was cause for concern, but my debriefing with the CIA and FBI following the trip was cause for outright alarm: neither had ever heard of LIWA or the data mining capability it possessed.
'Able Danger' Could Rewrite History
As a result of experiences such as these, I introduced language into three successive Defense Authorization bills calling for the creation of an intelligence fusion center which I called NOAH, or National Operations and Analysis Hub. The NOAH concept is certainly familiar now, and is one of several recommendations made by your commission that has a basis in earlier acts of Congress. Despite my repeated efforts to establish NOAH, the CIA insisted that it would not be practical. Fortunately, this bureaucratic intransigence was overcome when Congress and President Bush acted in 2003 to create the Terrorism Threat Integration Center (now the National Counterterrorism Center). Unfortunately, it took the deaths of 3,000 people to bring us to the point where we could make this happen. Now, I am confident that under the able leadership of John Negroponte, the days of toleration for intelligence agencies that refuse to share information with each other are behind us.
The 9-11 Commission produced a book-length account of its findings, that the American people might educate themselves on the challenges facing our national effort to resist and defeat terrorism. Though under different circumstances, I eventually decided to do the same. I recently published a book critical of our intelligence agencies because even after 9/11, they were not getting the message. After failing to win the bureaucratic battle inside the Beltway, I decided to take my case to the American people.
In recent years, a reliable source that I refer to as "Ali" began providing me with detailed inside information on Iran's role in supporting terror and undermining the United States' global effort to eradicate it. I have forwarded literally hundreds of pages of information from Ali to the CIA, FBI, and DIA, as well as the appropriate congressional oversight committees. The response from our intelligence agencies has been underwhelming, to put it mildly. Worse, I have documented occasions where the CIA has outright lied to me. While the mid-level bureaucrats at Langley may not be interested in what I have to say, their new boss is. Porter Goss has all of the information I have gathered, and I know he is ready to do what it takes to challenge the circle-the-wagons culture of the CIA. And Pete Hoekstra, the chairman of the House Intelligence Committee, is energized as well. Director Goss and Chairman Hoekstra are both outstanding leaders that know each other well from their work together in the House of Representatives, and I will continue to strongly support their efforts at reform.
All of this background leads to the reason I am writing to you today. Yesterday the national news media began in-depth coverage of a story that is not new. In fact, I have been talking about it for some time. From 1998 to 2001, Army Intelligence and Special Operations Command spearheaded an effort called Able Danger that was intended to map out al Qaeda. According to individuals that were part of the project, Able Danger identified Mohammed Atta as a terrorist threat before 9/11. Team members believed that the Atta cell in Brooklyn should be subject to closer scrutiny, but somewhere along the food chain of Administration bureaucrats and lawyers, a decision was made in late 2000 against passing the information to the FBI. These details are understandably of great interest to the American people, thus the recent media frenzy. However I have spoken on this topic for some time, in the House Armed Services and Homeland Security Committees, on the floor of the House on June 27, 2005, and at various speaking engagements.
The impetus for this letter is my extreme disappointment in the recent, and false, claim of the 9-11 Commission staff that the Commission was never given access to any information on Able Danger. The 9-11 Commission staff received not one but two briefings on Able Danger from former team members, yet did not pursue the matter. Furthermore, commissioners never returned calls from a defense intelligence official that had made contact with them to discuss this issue as a follow on to a previous meeting.
In retrospect, it appears that my own suggestions to the Commission might have directed investigators in the direction of Able Danger, had they been heeded. I personally reached out to members of the Commission several times with information on the need for a national collaborative capability, of which Able Danger was a prototype. In the context of those discussions, I referenced LIWA and the work it had been doing prior to 9/11. My chief of staff physically handed a package containing this information to one of the commissioners at your Commission's appearance on April 13, 2004 in the Hart Senate Office Building. I have spoken with Governor Kean by phone on this subject, and my office delivered a package with this information to the 9-11 Commission staff via courier. When the Commission briefed Congress with their findings on July 22, 2004, I asked the very first question in exasperation: "Why didn't you let Members of Congress who were involved in these issues testify before, or meet with, the Commission?"
The 9-11 Commission took a very high-profile role in critiquing intelligence agencies that refused to listen to outside information. The commissioners very publicly expressed their disapproval of agencies and departments that would not entertain ideas that did not originate in-house. Therefore it is no small irony that the Commission would in the end prove to be guilty of the very same offense when information of potentially critical importance was brought to its attention. The Commission's refusal to investigate Able Danger after being notified of its existence, and its recent efforts to feign ignorance of the project while blaming others for supposedly withholding information on it, brings shame on the commissioners, and is evocative of the worst tendencies in the federal government that the Commission worked to expose.
Questions remain to be answered. The first: What lawyers in the Department of Defense made the decision in late 2000 not to pass the information from Able Danger to the FBI? And second: Why did the 9-11 Commission staff not find it necessary to pass this information to the Commissioners, and why did the 9-11 Commission staff not request full documentation of Able Danger from the team member that volunteered the information?
Answering these questions is the work of the commissioners now, and fear of tarnishing the Commission's legacy cannot be allowed to override the truth. The American people are counting on you not to "go native" by succumbing to the very temptations your Commission was assembled to indict. In the meantime, I have shared all that I know on this topic with the congressional committee chairmen that have oversight over the Department of Defense, the CIA, the FBI, and the rest of our intelligence gathering and analyzing agencies. You can rest assured that Congress will share your interest in how it is that this critical information is only now seeing the light of day.

WASHINGTON — Staff assistants to the Sept. 11 commission are planning a trip to the National Archives to retrieve their notes on a U.S. military unit's information that four of the Sept. 11, 2001 hijackers were inside the United States a year before the attacks, FOX News has learned.
Defense Department documents show that the information, developed by a classified defense intelligence unit dubbed "Able Danger," wasn't handed over to the FBI because of concerns about pursuing information on foreigners admitted to the country for permanent residence.
A source familiar with the Sept. 11 commission told FOX News on Wednesday that the aides who still have security clearances are looking for a memo about a briefing given to four staff members by defense intelligence officials during an overseas trip to Afghanistan, Pakistan and Saudi Arabia in Fall 2003.
The date of the archives expedition is not yet known. The National Archives are located just outside of Washington, D.C.
The activity comes after Lee Hamilton (search), co-chairman of the now-disbanded commission, said he wanted to know whether defense intelligence officials knew of the Al Qaeda-linked attackers' activity but failed to tell law enforcement.
In an interview with FOX News, Hamilton said there should be a comprehensive review by Congress and the Pentagon into the claims. He said this potentially cruicial information could change the way history sees Sept. 11, 2001.
Members of the commission are reviewing claims that more than a year before the 2001 attacks defense intelligence officials had identified ringleader Mohammed Atta (search) and three other hijackers, and that they were already inside the United States. A statement could come by the end of the week
"The Sept. 11 commission (search) did not learn of any U.S. government knowledge prior to 9/11 of surveillance of Mohammed Atta or of his cell," said Hamilton, a former Democratic congressman from Indiana. "Had we learned of it obviously it would've been a major focus of our investigation."
Hamilton's remarks Tuesday followed findings by Rep. Curt Weldon (search), R-Pa., vice chairman of the House Armed Services and Homeland Security committees, that made front-page news.
In June, Weldon displayed charts on the floor of the U.S. Senate showing that Able Danger identified the suspected terrorists in 1999. The unit repeatedly asked for the information to be forwarded to the FBI but apparently to no avail. Various news outlets picked up on the story this week.
Weldon told FOX News on Wednesday that staff members of the Sept. 11 commission were briefed at least once by officials on Able Danger, but that he does not believe the message was sent to the panel members themselves. He also said some phone calls made by military officials with Able Danger to the commission staff went unreturned.
"Why weren't they briefed? Was there some deliberate attempt at the staff level of the 9/11 commission to steer the commissioners away from Able Danger because of where it might lead?" Weldon asked. "Why was there no mention of Able Danger?"
Pentagon spokesman Bryan Whitman said the Sept. 11 commission looked into the matter during its investigation of government missteps leading to the attacks and chose not to include it in the final report.
A group of Sept. 11 widows called the September 11th Advocates issued a statement Wednesday saying they were "horrified" to learn that further possible evidence exists, and they are disappointed the Sept. 11 commission report is "incomplete and illusory."
"The revelation of this information demands answers that are forthcoming, clear and concise," the statement said. "The Sept. 11 attacks could have and should have been prevented."
Sept. 11 Staffers Investigate
Hamilton confirmed that commission staff members learned of Able Danger during a meeting with military personnel in October 2003 in Afghanistan, but that the staff members do not recall learning of a connection between Able Danger and any of the four terrorists now mentioned. He also said no mention made of Atta.
It was "inconceivable" that staffers would have missed such a reference, Hamilton told FOX News.
According to the source who spoke with FOX News, none of the staffers believe they were ever told specifically about Atta having been identified by defense intelligence before the 2001 attacks.
But after the October 2003 trip, the commission staff members pursued Able Danger further and asked the Pentagon to produce documents related to the unit, which they were, FOX News has also learned.
Still, Defense Secretary Donald Rumsfeld said this week that he was unaware of the intelligence until the latest reports surfaced.
The source said three key questions need to be answered: Did defense intelligence identify Atta before the attacks? If so, was this information ever passed onto the commission? Was Rumsfeld ever briefed by his predecessor, Bill Cohen, on the unit and its findings?
"If the Sept. 11 commission staff made a mistake and missed this information, we will be the first to admit it. That is why we are going back to the archives to check our work, but at this time, staff do not believe this information was ever made available to them," the source said.
The commission's report on the terrorist attacks, released last year, traced government mistakes that allowed the hijackers to succeed. Among the problems the commission cited was a lack of coordination between intelligence agencies.
With the Sept. 11 commission disbanded for a year under provisions of the legislation that created it, some of the panel's members have said congressional committees should investigate Weldon's assertions.
"I can tell you right now, there are investigations going on right now… trying to get answers," Weldon told FOX News on Wednesday.
A 'Series of Mysteries'
According to Weldon, Able Danger identified Atta, Marwan al-Shehhi (search), Khalid al-Mihdar (search) and Nawaf al-Hazmi (search) as members of a cell Able Danger code-named "Brooklyn" because of some loose connections to New York City.
Weldon said that in September 2000, the unit recommended on three separate occasions that its information on the hijackers be given to the FBI "so they could bring that cell in and take out the terrorists." However, Weldon said Pentagon lawyers rejected the recommendation, arguing that Atta and the others were in the country legally so information on them could not be shared with law enforcement.
"Lawyers within the administration — and we're talking about the Clinton administration, not the Bush administration — said 'you can't do it,'" and put post-its over Atta's face, Weldon said. "They said they were concerned about the political fallout that occurred after Waco ... and the Branch Davidians."
Defense Department documents show that the Able Danger team was set up in 1999 to identify potential Al Qaeda operatives for U.S. Special Operations Command. Information provided to the team by the Army's Information Dominance Center (search) pointed to a possible Al Qaeda cell in Brooklyn.
However, because of concerns about pursuing information on "U.S. persons" — a legal term that includes U.S. citizens as well as foreigners admitted to the country for permanent residence — Special Operations Command didn't give the Army information to the FBI. It is unclear whether the Army provided the information to anyone else.
The command instead turned its focus to overseas threats.
The documents provided no information on whether the team identified anyone connected to the Sept. 11 attacks on New York City and Washington that killed nearly 3,000 people.
The prohibition against sharing intelligence on "U.S. persons" should not have applied since they were in the country on visas and did not have permanent resident status, said Weldon.
Able Danger was largely using open-source information that was available on the Internet and in other public media, he added.

Bob Graham, former chairman of the Senate Intelligence Committee, told FOX News on Wednesday that Congress not only needs to investigate the Able Danger claims but also needs to investigate other related issues, such as how German intelligence agencies alerted the United States that members of the Hamburg Al Qaeda cell were coming to America.
What also needs to be investigated further, Graham said, is how two Sept. 11 terrorists were living in a building in San Diego where their landlord was actually an FBI informant. The FBI is not saying what the informant told the agency about those terrorists, he said.
"I anticipate [Congress] will be getting on to their job with a great deal of commitment and expertise in this area. I hope it doesn't end with this one instance of why we didn't know about Atta," said Graham, author of "Intelligence Matters."
"There's not just one mystery here — there's a series of mysteries about why we didn't learn about this plot early enough to break it up," he added.

WASHINGTON — U.S. law enforcement never received information on Sept. 11 ringleader Mohamed Atta (search) and his possible connections to Al Qaeda, even though that information was known more than a year before the attacks that left approximately 3,000 people dead, Rep. Curt Weldon (search) said Tuesday.
Weldon, a Pennsylvania Republican and vice chairman of the House Armed Services and Homeland Security committees, said the hijackers were identified in 1999 by a classified military intelligence unit known as "Able Danger," which determined they could be members of an Al Qaeda cell. A military spokesman would not confirm or deny the unit's existence to FOX News.
A Weldon spokesman told FOX News that his boss stands by the claim that military intelligence identified the hijackers who were operating inside the United States.
In September 2000, the unit recommended that its information on the hijackers be given to the FBI "so they could bring that cell in and take out the terrorists," Weldon said in an interview with the Associated Press.
However, Weldon said Pentagon lawyers rejected the recommendation because they said Atta and the others were in the country legally.
"In fact, I'll tell you how stupid it was. They put stickies on the faces of Mohamed Atta on the chart that the military intelligence unit had completed and they said you can't talk to Atta because he's here on a green card," Weldon said.
He did not provide details on how the intelligence officials first identified the future hijackers and determined they might be part of a cell.
The congressman, who has occasionally been considered a maverick on Capitol Hill, initially made his allegations in a floor speech in June that attracted little attention. His talk came at the end of a legislative day during a period described under House rules as "special orders" — a time slot for lawmakers to get up and speak on issues of their choosing.
"Two weeks after 9/11, my friends from the Army's information dominance center, in cooperation with special ops, brought me a chart," Weldon said on the House floor. "What's interesting in this chart of Al Qaeda is the name of the leader of the New York cell. And that name is very familiar to the American people. That name is Mohamed Atta."
Weldon continued, saying that he brought the chart to Steve Hadley, who was then the deputy national security adviser. When Hadley said he wanted to show the chart to the president, Weldon asked if the CIA hadn't already done so. Hadley said no.
"So prior to 9/11, this military system that the CIA said we didn't need and couldn't do, actually identified Mohamed Atta and the cell in New York, and with Mohamed Atta they identified two of the other terrorists with him," Weldon said on the House floor. "Not only did our military identify Mr. Atta, our military made a recommendation on September 2000 to bring the FBI in and take out that cell."
Weldon told FOX that the "Able Danger" unit told its bosses that the information should be shared with the FBI.
A spokesman for U.S. Special Operations Command said there is no knowledge of Able Danger within Special Operations command headquarters right now.
Weldon said the unit is now defunct.
"It no longer exists," he told FOX. "It was disbanded."
Three other hijackers were also identified as Marwan al-Shehhi, Khalid al-Mihdar and Nawaf al-Hazmi. The information was not shared, in part, because those men were all in the United States on valid entry visas, Weldon's spokesman confirmed. Intelligence agencies at that time were uncomfortable singling out individuals who were in this country legally.
The issue resurfaced Monday in a story by the bimonthly Government Security News, which covers national security matters.
Pentagon spokesman Bryan Whitman said the Sept. 11 commission (search) looked into the matter during its investigation into government missteps leading to the attacks and chose not to include it in the final report.
Al Felzenberg, a spokesman for the Sept. 11 commission, confirmed that the panel's investigators had been aware of Able Danger but said they "don't recall any mention of Mohamed Atta, per se, or any mention of a ... cell."
The Sept. 11 commission report, considered the most exhaustive analysis of events leading up to the attacks, never mentions the defense intelligence group. If Weldon's claims are accurate, it means Atta was identified as a threat and it would amount to another missed opportunity.
One law enforcement source, however, told FOX News that he believes a repeat missed opportunity is unlikely because many of the information-sharing problems have been solved.

This is a partial transcript of "The Big Story With John Gibson," July 20, 2005, that has been edited for clarity.
JOHN GIBSON, HOST: The father of the 9/11 hijacker Mohamed Atta (search) is praising the bombings in London and says his son's attack was the start of a 50-year religious war.
Joining us now is Bill Daly, former FBI investigator and senior vice president of Control Risks Group, a security consulting firm.
So, this is Mohamed Atta's father. He said this to a reporter. He wouldn't do the interview on videotape unless he got $5,000 payment. And he told the reporter, if I get the $5,000, I'm going to give it to a bomber to go blow up some Brits or Americans. What does this tell us?
BILL DALY, FORMER FBI INVESTIGATOR: Well, first of all, John, this is a far cry from the father of Mohamed Atta we saw after 9/11 (search), who just couldn't believe it and was in total denial and said, "It couldn't be my son," to where we have somebody today who is out there proclaiming and supporting this cause, this horrendous terrorist cause.
So, I think what we're seeing is somebody who may be having some, you know, this whole change in personality as a result of dealing with his son being involved.
GIBSON: But could it be that he's reflecting what Egyptians are thinking and the problem is a whole lot worse in our friend Egypt (search) than we thought?
DALY: Well, I don't know if it's just Egypt. But I think he's suggesting that this is a very long war. It's something that is now recruiting young people, like we've seen in London, outside of London, where we have people in their 20s and just turning 30 who are getting into this fundamentalist belief, who want to kill themselves at a young age for this.
And he's suggesting that this is something that is going to go on and on.
GIBSON: What did you think of our last guest, who said, "Oh, this is bad; we condemn bombing, but, you know, it's really the fault of the people who constructed this foreign policy and, if you would just change your policy, you'd have less problems with bombers"?
DALY: Well, certainly, it sounds like an attempt to change policy as a result of terrorist attacks.
DALY: As opposed to exactly what it is. These are horrendous acts against mankind and can't be tolerated.
GIBSON: But did we just actually hear a blackmail threat? If you don't stop this, you're going to get more of it?
DALY: Well, I didn't hear it exactly that way. But the subtlety of it was that, if policy changes, maybe these will go away. But I don't believe, John, that even if that policy changes, it goes away.
The fundamental causes of these terrorist acts go much deeper and it goes into how these people are recruited and why they're so susceptible at a young age. And maybe we need to look at some of those issues, whether it's employment, whether it's having people more ingrained into the society they're in. But it's troubling that three out of these four terrorists in London were born and raised there.
GIBSON: Do your people in your business believe Mohamed Atta's father is right, that it's a 50-year war?
DALY: I believe that it is a protracted war. I think 50 years is something to stun everyone, to have people thinking that this is going to go on — on to our children and our children's children. I don't believe that. I believe we can come to a quicker resolution.
But it's something, John, that we realize it's not going to be a signed declaration on the stern of an aircraft carrier or something where we have a piece of parchment. The end of terrorism will be the sign that no more occurs.

you're not going to have something that had anything to do with 9/11
unless there was some intelligence to share. And it's becoming more and
more evident that there wasn't any intelligence to share. O'REILLY: So
you don't believe Shaffer? GORTON: Shaffer? O'REILLY: You think
Shaffer's lying? GORTON: Shaffer originally said that he told our staff
in Afghanistan about Mohammed Atta. He didn't. There were four people
there. None of them heard it. Since then, he has agreed that he did not
do this. O'REILLY: All right, well, wait, wait, wait. GORTON: Now he
says. O'REILLY: Wait, wait. GORTON: Now he says that he first learned
about it from someone else. O'REILLY: But senator, look. GORTON: ...in
the Defense agencies after 9/11. If he learned it after 9/11, how could
he have wanted to turn it over to prosecutors in the year 2000?
O'REILLY: Senator, you just heard a sound bite from Colonel Shaffer that
was recorded on Friday, three days ago, OK? He flat-out says — and I
don't know whether he's telling the truth or not. I don't know. How do I
know? I wasn't there. But he flat-out says that his crew, Able Danger,
brought information to the U.S. government that Mohammed Atta (search)
was in the United States legally — he came in on a visa, all right — was
a threat and was told to shut up, stuff it. Intelligence can't go over
to the FBI so they could surveille him.
GORTON: Well. O'REILLY: That's what the colonel's saying. And you're saying he's a liar? GORTON: What we know on the 9/11 Commission is that he told us nothing about Mohammed Atta or anyone else in Afghanistan, but he did tell us about Able Danger (search). We followed up on Able Danger. We got records about Able Danger from the Department of Defense. It had nothing about Mohammed Atta in it. O'REILLY: OK. And I believe you. I believe you. GORTON: Since this has come out, the Defense Department... O'REILLY: ...they issued a statement saying they didn't know anything. GORTON: ...has said they have something. O'REILLY: Absolutely. GORTON: It has nothing. And as of today, it tells us that the civilian female, whom Colonel Shaffer has as a source, does not corroborate what he has to say. O'REILLY: OK. And that's all true. GORTON: There was nothing to share. O'REILLY: The Defense Department said — OK. And I believe you. I don't know if I believe the Defense Department or not. —That's a bureaucracy. But I believe you. You're an honorable man. You're saying you didn't know. And I believe you. But, what I know to be true is that there was a tremendous amount of confusion, from 1995 onward after this crazy act that Janet Reno for some reason in her office made everybody aware of, that Intelligence sources overseas were not to brief criminal investigators like the FBI. —We know they have an intelligence arm, the criminal investigators. —If they got something, it was a violation of people's rights. GORTON: No. O'REILLY: Now you know that as well as I do. GORTON: No, you have slightly misstated it, but the misstatement is a very important one. They were not to go to U.S. attorneys who were prosecuting cases. There was no limitation on any intelligence agency sharing anything with any other intelligence agency at all. And so if... O'REILLY: So you think that subtlety was known by all of the investigators? GORTON: Subtlety? It isn't a remote subtlety. O'REILLY: I think it was a culture established by Attorney General Reno. GORTON: No. O'REILLY: ...that don't get involved. GORTON: No. O'REILLY: The overseas people doesn't get involved. GORTON: There was a policy established by Congress and by judges that you couldn't use intelligence information gotten through one kind of -- you know, of subpoena or wiretap in criminal prosecutions. It had nothing to do with sharing among agencies. And as you've rightly said, when it was finally taken down, you know, not by Ashcroft who just -- who went along completely with what Jamie Gorelick said, but by The Patriot Act. O'REILLY: Right. GORTON: ...the court still tried to interfere with it until an appeals court finally ended that wall. O'REILLY: OK. GORTON: And today, we aren't getting the kind of cooperation we ought to have. O'REILLY: I think you and I agree on 90 percent of this issue, but there's one thing we disagree on. And if you think about it overnight, I think you might see my point of view here. I'll put forth where I think you're making your mistake. And then I'll give you the last word. There was a culture created when Janet Reno was attorney general. And we know this. She refused to investigate the Chinese contributions to our political campaigns. The Riyadi family, she refused to get involved with any kind of overseas Intelligence, vis-a-vis people on U.S. soil. She flat-out wouldn't do it. Jamie Gorelick (search) was one of her top deputies who bought into this entirely. The message was sent if you have stuff overseas, Intelligence overseas, don't bother us with it. And I believe that firmly. Senator, I'll give you the last word, Sir. GORTON: We agree on a number of things. I'm no defender of Janet Reno as an attorney general. But what I'm telling you is that "the wall" was created by laws sponsored by the Church committee back in the 1970's. And they went all the way through until after 9/11 was over. And that nothing Jamie Gorelick wrote had the slightest impact on the Department of Defense or its willingness or ability to share intelligence information with other intelligence agencies.
