Franklin plead guilty to one count of conspiracy to communicate national defense information to one not entitled to receive it, and one count of conspiracy to communicate classified information to an agent of a country not entitled to receive it.  He is now a government witness.  Neither Rosen or Weissman had security clearances, Franklin held a top security clearance during the alleged conspiracy.  NDI code-word-protected information was passed, also secret FBI files relating to the Khobar Towers bombing, faxed information on a draft of US government Middle East policy, and information that related to potential attacks on the U. S. forces in Iraq, and foreign covert actions in Iraq.  Franklin warned Rosen and Weissman that it was all highly classified and they could get into trouble for having the information.  Rosen and Weissman denied to FBI agents they had received the information.

He is credited for making AIPAC into the most powerful foreign policy lobby organization in the U.S. (See The Israel Lobby and U.S. Foreign Policy.) Prior to Rosen's arrival at AIPAC, the lobby limited itself to Congressional advocacy. Rosen created its executive branch lobbying program which led him directly into his current troubles. Rosen is considered a political conservative, although he has told media outfits that his parents were "proud left-wing progressives." He has been married six times. • JTA  The federal judge in the classified information case against two former AIPAC staffers set a trial date of Oct. 28.  Separately, Ellis ruled in favor of the prosecution in allowing as evidence a Washington Post article from June 15 2003; that article, by Michael Dobbs, on Iran policy wars within the Bush administration, quoted senior administration officials as refusing to discuss a directive by President Bush on Iran because it is classified.   ....    The same directive was allegedly the topic of discussion between Rosen, Weissman and Larry Franklin, then a Pentagon Iran analyst. The prosecution intends to use the article to show that Rosen and Weissman likely knew the document, a National Security Presidential Directive, was classified. Franklin has pleaded guilty in the case.
  • Christian Science Monitor "J Street," a new lobby which describes itself as pro-Israel. It's directed by Jeremy Ben-Ami, a former Clinton official whose father fought alongside Menachem Begin for Israel's independence. J Street (a play on the K Street address of many lobbyists), seeks a less hard-line US policy in the Middle East and wants to create an environment in which politicians can confidently discuss such a change without fear of political punishment or being labeled anti-Semitic. Several US groups share J Street's views but they don't have much political muscle. J Street wants to build clout by using the Internet to raise money from small donors, and to contribute to congressional campaigns. ... Next week, it will endorse several candidates who support a major US push for a negotiated, two-state solution to the Palestinian crisis. J Street also favors dialogue with Israel's enemies, including Hamas and Iran; an Israeli-Syrian peace deal; and US withdrawal from Iraq.

  •   Jewish Week  pic, file Trial Of Ex-AIPAC Staffers Postponed, Rice subpoena allowed in AIPAC case as judge pushes trial date to August. Ron Kampeas JTA Alexandria, Va.  Two former AIPAC lobbyists say Secretary of State Condoleezza Rice was their informant on sensitive national security matters.  ...  The claim, laid out in a courtroom here last Friday, intensified the drama surrounding a trial that could further roil a Washington political establishment already consumed by cases involving "official" and "unofficial" leaks.  ...  The trial date, originally scheduled to begin April 25, has now been set for Aug. 7, even as the judge in the case continues to suggest the case might not go to trial at all.  ...  In last week's pretrial hearing, lawyers for Steve Rosen, the pro-Israel lobby's former foreign policy director, and Keith Weissman, its former Iran analyst, persuaded federal Judge T.S. Ellis III to allow a subpoena for the secretary of state and three other current and former Middle East policy officials.  ...  Rosen and Weissman were indicted last August on charges that they relayed classified information to fellow AIPAC staffers, journalists and diplomats at the Israeli Embassy in Washington.  ... AIPAC fired Rosen and Weissman in March 2005, saying their actions did not comport with the group's practices. Federal prosecutors have made clear that AIPAC is not suspected of wrongdoing.  ...  The judge continued to express grave doubts about the government's case, sympathizing with defense claims that it could impinge on free speech rights, and that it lacked precedent.  ...  When Kevin DiGregory, the lead prosecutor, pointed out that the First Amendment had never been cited in a similar case, Ellis chided him, saying, "Well, no case has been like this one."  ...  Setting out a pretrial schedule, Ellis pointedly would not count out a dismissal before the start of the trial and several times qualified prospective dates, saying "if there is going to be a trial."  full article
  • Institute of Research "While compelled testimony from the authors of the most disastrous foreign policy in the nation's history may seem to be a welcome ray of light, it is unlikely to ever happen. The defense may be counting on this as a "graymail" strategy to get the case thrown out, thereby avoiding the embarrassment of current and former officials. Judge Ellis gave AIPAC reason hope it may work. It is likely that the subpoenaed witness will not appear on grounds of "executive privilege". If Ellis reads the news, he knows that this has already occurred when Bush administration officials refused to appear before Congress to discuss the firing of US attorneys. If this happens again, the case against AIPAC will be over ... "
  • WSJ "Much of the information (passed from Franklin to Rosen, Weissman then to Israel) was about Iran's plans for destabilizing Iraq. Mr. Franklin, who was also indicted, subsequently pleaded guilty and was sentenced to 12 years in prison. Under intense government pressure he has agreed to testify against his friends, the former AIPAC lobbyists. Their trial is set for January
  • Huffington Post  "Chuck Schumer and Dianne Feinstein's endorsement of Michael Mukasey is stunning.  ... There are more reasons to reject Michael Mukasey's nomination than his evasive answers on waterboarding and unconstitutional expansive views of federal power. Years ago, Michael Mukasey defended the indefensible when his friend, Rudolph Giuliani, then a prosecutor, began subpoenaing defense lawyers before grand juries. ... It was one of the more substantial overreaches of the Giuliani years. And it is of particular relevance in today's criminal cases that bear the terrorism label -- a brand of cases where the government's failure rate today is very high. It can be aimed at the country's best defense lawyers and those lawyers that defend detainee, rendition and terrorism cases."
  • Antiwar "The indictment outlines a series of meetings between Rosen and at least two unidentified U.S. government officials – since identified as David Satterfield and Kenneth Pollack – in which the man who built AIPAC into a lobbying powerhouse turned his organization into a transmission belt that routinely moved classified information from Washington to Tel Aviv. ... The defenders of Rosen and Weissman argue that this is a First Amendment case, but there is no First Amendment right to engage in espionage – or else why aren't the Rosenbergs considered martyrs to the principle of "free speech"? This isn't just about passing information to Israel. Franklin is an associate of neoconservative guru Michael Ledeen and fellow Pentagon analyst Harold Rhode, with whom he traveled to Rome in 2001 to attend an unauthorized meeting with Iranian "dissidents" and the scamster Manucher Ghorbanifar, of Iran-Contra fame (which Ledeen also played a key role in, as Israel's go-between). "
  • SeattlePI "Ellis, an appointee of President Reagan, left open the possibility that the Bush administration may challenge the subpoenas on the grounds they would reveal privileged information. But the judge said his ruling Friday "may trump a valid governmental privilege." ... If so, that could force the government to decide whether to allow the testimony or drop the case.  ... Neither the State Department nor the Justice Department would comment on the ruling.  ... Among those subpoenaed in the case were: former Deputy Secretary of Defense Paul Wolfowitz; former Deputy Secretary of State Richard Armitage; and Marc Grossman, former undersecretary of state for political affairs."

  • The Charges in United States v. Franklin: Conspiracy to Violate the Espionage Act,   from Findlaw

The indictment charges against all three men with conspiracy to communicate national defense information to persons not entitled to receive it in violation of 18 U.S.C. § 793(g) - a provision of the Espionage Act that requires that at least one of the co-conspirators acts in a manner to "effect the object of the conspiracy." (The "overt act" requirement is a common feature of conspiracy law, designed to prevent mere conversations from becoming the basis for criminal charges.)  To this end, the grand jury has also indicted Franklin on three counts of violating 18 U.S.C. § 793(d), which makes it a crime for a person, "lawfully having possession of, access to, control over, or being entrusted with . . . information relating to the national defense which information the possessor has reason to believe could be used to the injury of the United States or to the advantage of any foreign nation," to communicate it "to any person not entitled to receive it." The indictment asserts that Franklin's disclosures to Rosen, an American lobbyist, violated the Espionage Act. (Each violation carries a prison term of up to ten years.)  In addition, Rosen has also been indicted on one count of violating 18 U.S.C. § 793(e), which makes it illegal for someone who is not authorized to have access to classified national defense information to "willfully retain," let alone "willfully communicate," such information.  The implication of the charge against Rosen is, strikingly, that any private citizen who receives classified information, and then turns around and discloses it to any other private citizen, is violating the Espionage Act.

  • YNet News "Sources told Time that the probe has been going on for months. The probe would try to determine whether Harman and AIPAC enlisted wealthy supporters to "lobby" House Democratic leader Nancy Pelosi to reappoint Harman.   According to the sources, Israeli businessman Haim Saban is one of the wealthy individuals who lobbied for Pelosi on behalf of Harman. Saban contributed at least USD 3,000 to Harman's election campaign, congressional sources told Time.  Two senior AIPAC lobbyists are awaiting sentencing as part of an investigation that led to the suspension and imprisonment of former Defense Intelligence Agency official Lawrence A. Franklin, who pleaded guilty to having passed on classified intelligence to the two lobbyists.   AIPAC fired lobbyists Steven Rosen and Keith Weissman, who are accused of receiving classified information on terrorism and the Middle East from Franklin.  Harman: No knowledge of probe   ... The investigation will also attempt to determine whether AIPAC lobbied for Franklin to get a position at the National Security Council. According to the probe's findings, Franklin requested that AIPAC members "put in a good word" for him at the NSC in exchange for the documents he relayed to them. AIPAC, on its part, considered such an appointment to be beneficial for the organization, as it would put Franklin in a position close to the president, and said that they would do their best on the matter, the FBI claimed.  Harman's attorney told the Time that: "(Congresswoman Harman) is not aware of any such investigation, does not believe that it is occurring, and wanted to make sure that you and your editors knew that as far as she knows, that's not true... .
  • WayneMadsenReport " The word is that Harman's involvement with AIPAC has torpedoed her chances of becoming HPSCI chair with California's two Democratic Senators, Dianne Feinstein and Barbara Boxer, both weighing in with Pelosi against Harman becoming chairman."
  • WayneMadsenReport "Federal law enforcement sources report that a senior retired Mossad officer is the subject of a sealed indictment in the Larry Franklin-America Israel Public Affairs Committee (AIPAC) espionage case. The retired officer, a former terrorism adviser to Prime Minister Binyamin Netanyahu, worked under a relatively new type of Israeli intelligence cover in Washington -- association with a think tank, in this case the neo-conservative Hudson Institute. The subject of the sealed indictment and other Israeli agents using U.S. think tank cover operate as handlers for spies like Franklin and others."
  • MediaMonitors " The spurned Harman embarked on an aggressive campaign to persuade Pelosi to reappoint her. According to Time, the alternative LA Weekly reported that Harman “had some major contributors call Pelosi to impress on her the importance of keeping her as head of the House Intelligence Committee. These tactics did not endear Harman to Pelosi.”  Among those who called Pelosi on Harman’s behalf, according to Time, was billionaire Zionist Haim Saban.  Harman has hired GOP super lawyer Ted Olson, a former solicitor general, because, Olson told Time, “she is not aware of any such [FBI] investigation, does not believe it is occurring and wanted to make sure you and your editors know that as far as she knows, that’s not true…No one from the Justice Department has contacted her.”
  • CounterPunch "Vintage Zionist bravado was uncorked by Benjamin Netanyahu during his closed-door meeting last month with American contributors to an Israeli military recruitment program targeting ultra-religious Jews. The American-educated former Israeli Prime Minister, now hardline opposition leader and magnet for the right, has called for a pre-emptive nuclear strike against Iran. Netanyahu was the original recipient of the neo-con expansionist "clean break" blueprint in the nineties, which was eventually recycled back in the U.S. as the Program for a New American Century.
  • Asia Times, "Let us not forget that the Iraq crisis today is also a crisis of American hegemony," a Tehran political analyst told this author recently, adding that a net benefit of this "double crisis" for Iran has been the absence of an invasion by the US - the augment being that in all probability the US would have invaded Iran by now had it succeeded in Iraq."
  • WMR Dan Senor, who served under CPA viceroy L. Paul Bremer III, was seen as carrying the water for extreme right-wing and pro-Israelis inside the Pentagon and the Likud government in Israel. Senor was an intern for the American Israel Public Affairs Committee (AIPAC). His sister is the head of the AIPAC office in Jerusalem and his brother-in-law is the editorial page editor for the neocon Jerusalem Post. Senor was also a director of the US-Israel Business Exchange (USIBEX) and was an senior associate of The Carlyle Group. Senor served as McClellan's deputy press secretary at the White House before taking the CPA job in Baghdad. Senor is married to NBC News correspondent Campbell Brown.  (see also: Tony Snow)
How Bush neo-cons and AIPAC are using the Franklin, Rosen Weissman indictments to undermine freedom of the press in America.
  • The successful prosecution of Franklin, Rosen and Weissman and bills like Senate Bill 3774 enables Bush administration to prosecute anyone they choose for leaking classified information.
  • This sets a dangerous precedent and undermines a free press.
  • Does this put the 'left' in the curious position of defending these indicted individuals even considering they were enabling neo-con schemes?
