information to one not entitled to receive it, and one count of
conspiracy to communicate classified information to an agent of a
country not entitled to receive it. He is now a government
witness. Neither Rosen or Weissman had security clearances,
Franklin held a top security clearance during the alleged
conspiracy. NDI code-word-protected information was passed, also
secret FBI files relating to the Khobar Towers bombing, faxed
information on a draft of US government Middle East policy, and
information that related to potential attacks on the U. S. forces in
Iraq, and foreign covert actions in Iraq. Franklin warned Rosen
and Weissman that it was all highly classified and they could get into
trouble for having the information. Rosen and Weissman denied to
FBI agents they had received the information.

AIPAC staffers set a trial date of Oct. 28. Separately, Ellis ruled in
favor of the prosecution in allowing as evidence a Washington Post article
from June 15 2003; that article, by Michael
Dobbs, on Iran policy wars within the Bush
administration, quoted senior administration officials as refusing to
discuss a directive by President Bush on Iran because it is
classified. .... The same directive was
allegedly the topic of discussion between Rosen, Weissman and Larry
Franklin, then a Pentagon Iran analyst. The prosecution intends to use the
article to show that Rosen and Weissman likely knew the document, a National

The
indictment charges against all three men with conspiracy to communicate
national defense information to persons not entitled to receive it in
violation of 18 U.S.C. § 793(g) - a provision of the Espionage Act that
requires that at least one of the co-conspirators acts in a manner to
"effect the object of the conspiracy." (The "overt act"
requirement is a common feature of conspiracy law, designed to prevent mere
conversations from becoming the basis for criminal charges.) To
this end, the grand jury has also indicted Franklin on three counts of
violating 18 U.S.C. § 793(d), which makes it a crime for a person,
"lawfully having possession of, access to, control over, or being
entrusted with . . . information relating to the national defense which
information the possessor has reason to believe could be used to the injury
of the United States or to the advantage of any foreign nation," to
communicate it "to any person not entitled to receive it." The
indictment asserts that Franklin's disclosures to Rosen, an American
lobbyist, violated the Espionage Act. (Each violation carries a prison term
of up to ten years.) In addition, Rosen has also
been indicted on one count of violating 18 U.S.C. § 793(e), which makes it
illegal for someone who is not authorized to have access to classified
national defense information to "willfully retain," let alone
"willfully communicate," such information. The
implication of the charge against Rosen is, strikingly, that any private
citizen who receives classified information, and then turns around and
discloses it to any other private citizen, is violating the Espionage
Act.

News "Sources told Time that the probe has
been going on for months. The probe would try to determine whether Harman
and AIPAC enlisted wealthy supporters to "lobby" House Democratic
leader Nancy Pelosi to reappoint Harman. According to the
sources, Israeli businessman Haim Saban is one of the wealthy individuals
who lobbied for Pelosi on behalf of Harman. Saban contributed at least USD
3,000 to Harman's election campaign, congressional sources told Time.
Two senior AIPAC lobbyists are awaiting sentencing as part of an
investigation that led to the suspension and imprisonment of former Defense
Intelligence Agency official Lawrence A. Franklin, who pleaded guilty to
having passed on classified intelligence to the two lobbyists.
AIPAC fired lobbyists Steven Rosen and Keith Weissman, who are accused of
receiving classified information on terrorism and the Middle East from
Franklin. Harman: No knowledge of probe ... The
investigation will also attempt to determine whether AIPAC lobbied for
Franklin to get a position at the National Security Council. According to
the probe's findings, Franklin requested that AIPAC members "put in a
good word" for him at the NSC in exchange for the documents he relayed
to them. AIPAC, on its part, considered such an appointment to be beneficial
for the organization, as it would put Franklin in a position close to the
president, and said that they would do their best on the matter, the FBI
claimed. Harman's attorney told the Time that: "(Congresswoman
Harman) is not aware of any such investigation, does not believe that it is
occurring, and wanted to make sure that you and your editors knew that as
far as she knows, that's not true... .
